CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80- 126 <br />BY: <br />~/ <br />AN ORDINANCE DECLARING THE NORTH OLMSTED MUNICIPAL <br />JAIL A TEMPORARY HOLDING FACILITY AND DECLARING AN <br />ED4ERGENCY. <br />WHEREAS, this Council on July 17, 1979, adopted Resolution <br />Number 79-87, urging the Ohio Department of Corrections to suspend <br />the minimum jail standards applicable to seventy-two (.72) hour <br />facilities, and <br />WHEREAS, the Ohio Department of Corrections has refused to <br />suspend the minimum jail standards, and <br />WHEREAS, the North Olmsted Jail facilities, although. modern <br />and built to present day standards, does not meet the stringent <br />standards set by the Ohio Department of Corrections, and <br />WHEREAS, the City of North Olmsted lacks sufficient funds to <br />comply with the seventy-two (72) hour facility standards. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby declare that the <br />North Olmsted Municipal Jail is considered to be a temporary holding <br />facility and as such need not meet the standards of a seventy-two <br />(_72) hour facility as rec{uired by the Ohio Department of Corrections. <br />SECTION 2: That the Director of Public Safety is hereby <br />directed t-o forward a copy of this Ordinance to the Ohio Department <br />of Corrections. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for th.e preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is immediately necessary to declare the Municipal Jail facilities <br />as that of being temporary holding facilities in order to meet the <br />1981 budget commitments, and further provided it receives the affirma- <br />tive vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />PASSED: <br />ATTEST: <br />FLORENCE CAMPBELL, CLERK OF COUNCIL <br />DEWEY H.
