<br />WHEREAS, it is the intent of the parties hereto that this <br />agreement supercede and replace any prior individual mutual <br />agreements which may have been entered into between them. <br />NOW, THEREFORE, the parties hereto, each in consideration <br />of the mutual promises and obligations set forth, agree as <br />follows: <br />1. For the purpose of affording additional fire assistance <br />and protection to themselves and their inhabitants, there shall <br />be an interchange of the services of the Fire Departments, and <br />the use of fire personnel and equipment, between the parties <br />hereto, and each of said parties will assist the other party <br />hereto by responding to any call from the Mayor, Director of <br />Public Safety, Chief of Fire or other party to this agreement, <br />with its fire equipment, personnel, and/or other emergency <br />vehicles, and will render like services while so responding as <br />it renders to itself and its own inhabitants, provided, however, <br />that in no case shall the party hereto called upon or rendering <br />such services be liable in damage to the other party hereto or <br />any of its inhabitants, or contractual obligees, for failure to <br />answer any call, or for lack of speed in answering any such call, <br />or for any inadequacy of equipment, negligent operation of <br />equipment, or for any cause whatsoever growing out of such use <br />of said fire equipment and personnel, nor shall the party hereto, <br />which issued such call. <br />2. Each of the parties hereto agrees to respond to an <br />emergency in the other agreeing city or township, on the call fro <br />the Mayor, Director of Public Safety, Chief of Fire or other <br />party designated by them, of such other contracting party, for <br />services of the fire department and its emergency equipment at <br />those times and places that would tend to require immediate or <br />long-term participation of services of the parties to this <br />agreement. The extent of such response by said responding party <br />shall be determined by the judgment of the Mayor, Director of <br />Public Safety, Chief of Fire or other party designated by them, <br />who saall retain in said municipal corporations sufficient <br />equipment and personnel consistent with the proper protection <br />of said responding cities or township. <br />3. When said authorized person of any of the parties hereto <br />calls for assistance, he shall state the specific emergency or <br />activity requiring participation by any of the parties hereto <br />stated. When such assistance is requested, the authorized <br />person requesting such assistance shall give explicit directions <br />as to the location where such assistance is required, and shall, <br />whenever possible, dispatch someone to a specific meeting place <br />to escort the persons responding to such call to their destinatio <br />4. No charge shall be made for the aforesaid service by <br />either of the parties hereto, and each of sa-id parties shall <br />assume the expense of any loss or damage to its own equipment <br />or apparatus which may be incurred while in the other party's <br />boundaries, or while responding to a call in accordance with or <br />under the terms of this agreement. <br />-2- <br />
