All personnel of the responding party, while responding <br />to a call of a calling party, shall be acting within the scope <br />of their employment by the responding party, while en route to, <br />en route from, and while acting within the territory of the <br />calling city or township. <br />6. On any occasion or at any place to which additional <br />assistance is called under and pursuant to the terms of this <br />agreement, the senior officer or officer in charge of the Police <br />Department of the calling city or township shall have full <br />charge and authority over such assisting equipment and personnel <br />of the responding city or township. <br />7. The members of the Police Department acting outside <br />the limits of the city or township in which they are employed, <br />may participate in any pension or indemnity fund established <br />by their employer to the same extent as while acting within <br />the employing city or township, and are entitled to all rights <br />and benefits of Sections 4123.01 to 4123.94, inclusive, of the <br />Ohio Revised Code, to the same extent as while performing <br />service within the city or township in which they are employed. <br />The pension or indemnity fund of the city or township calling <br />for such assistance shall not be liable for any benefits or <br />responsible in any way to any members of the Police Department <br />of the responding city or township. <br />8. The parties hereto shall not be required to reimburse <br />or indemnify any pension or indemnity fund of the other party. <br />for any pension or indemnity award or premium contribution <br />assessed against such party wherein the members of the Police <br />Department are employed, for Workmen's Compensation benefits and <br />for casualty insurance premiums arising or incurred by reason <br />of injuries to or death of a policeman of such party, as a <br />result of, or occurring while engaged in participating in police <br />activity or rendering service to such other party under the terms <br />of this agreement, or while going to or from the scene of an <br />activity or service, or while responding to a call pursuant to <br />the terms of this agreement. <br />9. This Agreement shall be in full force and effect between <br />the parties hereto from~the date herein above set forth, provided <br />however, any one of the parties hereto may give written notice, <br />at any time, to the other parties of its intention to terminate <br />this agreement and withdraw therefrom, and then this agreement <br />shall terminate thirty (30) days after receipt of said written <br />notice as to the said withdrawing party. Said agreement shall <br />continue in full force and effect as between the remaining <br />parties. <br />IN WITNESS WHEREOF, the respective parties hereto have, <br />upon the date hereinabove set forth, hereunto caused this <br />-3- <br />
