AN ORDINANCE AMENDING PART VII OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED BY ADDING THERETO A NEW CHAPTER 751 ENTITLED rrREGULATION OF GAME ROOMS". WHEREAS, the Council of the City of North Olmsted has determined that the current North. Olmsted Codified Ordinances fails to provide for the regulation of businesses established for the purpose of providing game rooms that keep and maintain electronic amusement devices, and WHEREAS, the Council of the City of North Olmsted deems it necessary to provide regulations of said game rooms for the health, safety and welfare, of the citizens of the City of North Olmsted. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That Part VII "Business Regulation Code" of the North. Olmste Codified Ordinances be amended by adding a new Chapter 751, which new Chapter shall be as follows: CHAPTER 751 REGULATION OF GAME ROOMS 751.01 DEFINITIONS. (.a)"Game Room or Amusement Arcade°' means a place of business within a building or any part of a building having more than three (3) mechanical or electrically operated amusement devices which are used for the purpose of public entertainment through the operation, use or play, of any table game or device commonly known as electronic games which is operated by placing therein any coin, plate, disc, plug, key, or token, of value or by the payment of a fee. (b)"Mechanical or Electrically Operated Amusement Device" means any coin operated machine, device or instrument, which. upon the insertion of a coin, token, slug, or payment of a fee, operates or may be operated for use as a game, contest of skill, or amusement, of any description which. in no way intends to encourage gambling. For the purposes of this Chapter, however, nothing contained herein shall be construed so as to permit the operation of pinball games which are prohibited under Section 517.06 of the Codified Ordinances of the City of North Olmsted. (c)"Owner" shall mean any person having possession of any mechanical or electrical amusement device or any person operating an amusement arcade or game room. 751.02 LICENSES REQUIRED. (a) No person being the owner of a game room or amusement arcade shall display for public patronage or keep for operation by the public, any mechanical or electrical amusement device without first obtaining a license issued by the Director of Public Safety in accordance with this Chapter.
