PETRIGAC <br />AN ORDINANCE AUTHORIZING IMPLEMENTATION BY THE CITY OF NORTH <br />OLMSTED OF THE NORTHEAST OHIO LAKE ERIE DRAINAGE BASIN (NEOLEB) <br />208 WATER QUALITY MANAGEMENT PLAN, AND PAYMENT OF DUES TO THE <br />NEOLEB BOARD. <br />WHEREAS, the 208 Water Quality Plan for the Northeast Ohio Lake Erie <br />Drainage Basin was adopted by the Northeast Ohio Lake Erie Basin (NEOLEB)208 <br />Policy Board on January 3, 1979 pursuant to Section 208 of the Federal Water <br />Pollution Control Act Amendments of 1972, PL 92-500, and the Clean Water Act of <br />1977, PL 95-217; and <br />WHEREAS, the adopted Plan has been certified by the Governor of the State of <br />Ohio, and approved by the Regional Administrator of the United States Environmental <br />Protection Agency; and <br />WHEREAS, a Council on Water Quality has been formed under the auspices of the <br />NEOLEB 208 Plan for the Black/Rocky River basins; and <br />WHEREAS, the adopted Plan recommends functions to be performed by designated <br />management agencies through an Agreement to Implement: <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, <br />County of Cuyahoga, State of Ohio: <br />Section 1. That the 208 Water Quality Plan adopted by the NEOLEB Board on <br />January 3, 1979 is hereby accepted for implementation by the City of North Olmsted. <br /> <br />Section 2, That the City of North Olmsted accepts designation as a NEOLEB <br />Water Quality Management Agency and agrees to implement designated management <br />responsibilities recommended in the following Subplans of the NEOLEB 208 Plan: <br />(A) <br />(g) <br />(C) <br />Continuing Planning & Coordination <br />Subplan; <br />Waste-~ater Treatment Facilities <br />Subplan <br />Sewage Treatment <br />Subplan; <br />(D) Stormwater Runoff/Sediment <br />Control Subplan <br />(E) Rivers and Waterways Subplan; <br />and <br />(F) Environmental Health Subplan. <br />Plant Residuals <br />A water quality management policy guidance will be developed by the City of <br />North Olmsted pursuant to Subplan recommendations in consultation with the NEOLEB <br />staff, and incorporated in the Agreement to Implement as Attachment I. <br />Section 3. That the City of North Olmsted agrees to support and participate in <br />the Black/Rocky River Council on Water Quality, Bylaws of which are set forth in the <br />Agreement to Implement as Attachment III. <br />Section 4. That the City of North Olmsted assures that it possesses authority <br />to perform designated water quality management responsibilities. Statutory authority <br />will be referenced in the policy guidance incorporated as Attachment I. <br />Section 5. That the City of North Olmsted agrees to develop cooperative agree- <br />ments with other management agencies so far as necessary and practicable to ensure <br />performance of its designated responsibilities. <br />Section 6. That the c;ty of North Olmsted agrees to develop and. adopt financial <br />policies that will enable it to perform its designated responsibilities over the <br />next five (5) years. So far as is practicable, the policies will identify capital <br />and operating costs and funding sources necessary to implement designated responsi- <br />bilities. When adopted the financial policies will be incorporated into the Agreement <br />to Implement as Attachment II. <br />Section 7. That the City of North Olmsted agrees to implement its designated <br />responsibilities so far as resources: are available in conformity with an implementa- <br />tion schedule to be set forth. i;n the policy guidance incorporated as Attachment I. <br />
