<br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER
<br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE
<br />BUILDING ON PERMANENT PARCEL NUMBER 237-5-12, AT
<br />DECLARINGAAN EMER~ENCYTHE CITY OF NORTH OLMSTED, AND
<br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01
<br />to 1331.99 of the Codified Ordinances of the City of North Olmsted,
<br />the Building Commissioner has determined that the abandoned dwelling
<br />known as Permanent Parcel Number 237-5-12 located at 23977 Lorain
<br />Road, North Olmsted, Ohio, the record title holder being Barrett
<br />Brothers, a.k.a. Barrett Motors, is unsafe, dangerous to human life,
<br />and hazardous to the safety,. health and public welfare of the citizens
<br />of the City of North Olmsted, and
<br />WHEREAS, notice to repair, remove, or demolish said building
<br />was served by registered letter on said record title holder on
<br />March 28, 1980, ordering said title holder to repair, remove, or
<br />demolish said building and to commence such repair, removal, or
<br />demolition within sixty (60) days of receipt of said notice, and
<br />WHEREAS, said record title holder, Barrett Brothers, a.k.a.
<br />Barrett Motors, failed to reverse the Building Commissioner's order
<br />and has also failed to further appeal the decision of the Zoning
<br />Board of Appeals to a higher tribunal of competent jurisdiction and
<br />this time has failed to comply with the order of the Building
<br />Commissioner.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO:
<br />SECTION l: That Council deems it necessary to proceed with the
<br />demolition an removal of the frame dwelling at 23977 Lorain Road,
<br />North Olmsted, Ohio, also known as Permanent Parcel Number 237-5-12,
<br />owned by Barrett Brothers, a.k.a. Barrett Motors, whose mailing
<br />address is 23977 Lorain Road, North Olmsted, Ohio 44070, by reason
<br />of the fact that said dwelling has been determined to be dangerous
<br />to human life and a hazard to the public safety, health and welfare
<br />of the citizens of the City of North Olmsted, Ohio, and that the cost
<br />of said demolition in removal be paid from the General Fund of the
<br />City of North Olmsted and charged to the owner(s) as a special assess-
<br />ment or lien on such ,parcel of land and assessed and collected in the
<br />manner of other assessments as provided by law.
<br />SECTION 2: That the Clerk of Council be and she is hereby
<br />directed to orward a copy of this Ordinance to Barrett Brothers,
<br />a.k.a. Barrett Motors, 23977 Lorain Road, North Olmsted, Ohio 44070.
<br />SECTION 3: That this Ordinance is hereby declared to be an
<br />emergency measure immediately necessary for the preservation of the
<br />public health, safety and welfare, and for the further reason that the
<br />dilapidated condition of said dwelling is a serious hazard to the
<br />health, safety, and welfare of the citizens of North Olmsted, and
<br />further provided it receives the affirmative vote of two-thirds of
<br />all members of Council, it shall take effect and be in force immediately
<br />upon its passage and approval by the Mayor.
