,~ ' <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80- 41 <br /> <br />AN ORDINANCE AMENDING SECTION 353.07 OF CHAPTER <br />353 OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED, ENTITLED "FIRE LANES", AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Council of the City of North Olmsted has <br />reviewed the waiver provisions and has determined that the fees <br />are presently inadequate. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That Section 353.07 of the Codified Ordinances <br />of the City ~-North Olmsted entitled "Fire Lanes" now reading <br />as follows: <br />"353.07 WAIVER PROVISIONS. <br />(a)Whoever violates any provision of this chapter shall be <br />guilty of a misdemeanor. Any such person who has received notice <br />to appear and to answer to such violation, upon filing personally <br />with. the Chief of Police at the City Hall, a written plea of <br />guilty, commonly known as a waiver, within forty-eight hours <br />after such notification, Sundays or holidays excepted, may for <br />such offense pay a fine of five dollars ($5.00) without costs. If <br />such written plea is made after forty-eight hours after such notifica- <br />tion, Sundays or holidays excepted, then such violator may pay a <br />fine of ten dollars ($10.00), without costs. <br />(b) Upon failure of a violator to appear and make such pleas <br />as aforesaid within a seventy-two hour period, a warrant may be <br />issued for the arrest of the violator and upon conviction of the <br />offense, such violator shall be subject to the penalty provided in <br />Section 303.99 of this Traffic Code and all provisions incorporated <br />herein." <br />Be and the same is hereby amended and as amended shall read as <br />follows: <br />353.07 WAIVER PROVISIONS. <br />(a) Whoever violates any provision of this chapter shall be <br />guilty of a misdemeanor. Any such person who has received notice <br />to appear and to answer to such violation, upon filing personally <br />with the Chief of Police at the City Hall, a written plea of guilty, <br />commonly known as a waiver, within forty-eight hours after such <br />notification, Sundays or holidays excepted, may for such offense <br />pay a fine of seven dollars ($7.00) without costs. If such written <br />plea is made after forty-eight hours after such notification, <br />Sundays or holidays excepted, then such violator may pay a fine of <br />twelve dollars ($12.00) without costs. <br />(b) Upon failure of a violator to appear and make such pleas <br />as aforesaid within a seventy-two hour period, a warrant may be <br />issued for the arrest of the violator and upon conviction of the <br />offense, such violator shall be subject to the penalty provided in <br />Section 303.99 of this Traffic Code and all provisions incorporated <br />herein." <br />
