LOGAN <br />AN ORDINANCE AMENDING SECTION 513.09 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED ''CONTROLLED SUBSTANCE FOR PRESCRIPTION <br />LABELS" OF CHAPTER 513 OF THE GENERAL OFFENSES CODE <br />ENTITLED "DRUG ABUSE CONTROL", AS AMENDED. <br />WHEREAS, it has been determined by this Council that any <br />prescription drug which is r~rescribed by a physician expires <br />one year after issuance, and <br />WHEREAS, it is the desire of this Council to require <br />pharmacists to indicate on the prescription label the expiration <br />date. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Section. 513.09 of the Codified Ordinances <br />of the City of North Olmsted entitled "Controlled Substance for <br />Prescription Labels" of Chanter 513 entitled "Drug Abuse Control" <br />which now reads: <br />"513.09 CONTROLLED SUBSTANCE OR PRESCRIPTION LABELS. <br />(a) No person shall alter, deface or remove any label <br />affixed by a manufacturer, wholesaler, pharmacist or practitioner <br />who dispenses a controlled substance in a package or container, <br />as long as any of the original contents remain, except when <br />lawfully filling a prescription. <br />(b) Whoever violates this section is guilty of a misdemeanor <br />of the first degree, if the offender has not previously been <br />convicted of a violation of this section, Ohio R.C. 3719.07 <br />or 3719.08 or a drug abuse offense." <br />be and the same is hereby amended and as amended shall read as <br />follows: <br />513.09 CONTROLLED SUBSTANCE OR PRESCRIPTION LABELS. <br />(a) No person shall alter, deface or remove any label <br />affixed by a manufacturer, wholesaler, pharmacist or practitioner <br />who dispenses a controlled substance in a package or container, <br />as long as any of the original contents remain, except when <br />lawfully filling a prescription. <br />(b) The pharmacist shall not dispense any antibiotic pre- <br />scri~tion except in a container correctly labeled with the following: <br />the expiration date of the effectiveness of the drug dispensed if <br />such information is required on the original label of the manufacturer <br />of the drug. <br />(c) Whoever violates Subsection (a) of this section shall <br />be guilty of a misdemeanor of the first degree, if the offender <br />has not previously been convicted of a violation of this section, <br />Ohio R.C. 3719.07 or 3719.08 or a drug abuse offense. Any person <br />violating Subsection (b) of this section shall be guilty of a <br />minor misdemeanor. <br />
