,,,, <br />. ~ . <br />z <br />C <br /> L <br />t <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80-29 <br />BY : TIR• BOEHr'IER AND LAIRS SARINGER <br /><=rt~ <br />-mom <br />WEST SHORE CABLE TV, <br />AN ORDINANCE GRANTING TO (AN OHIO LIMITED PARTNERSHIP), <br />ITS SUCCESSORS AND ASSIGNS FOR A PERIOD OF FIFTEEN <br />(15) YEARS FROM AND AFTER THE PASSAGE, ACCEPTANCE <br />AND EFFECTIVE DATE OF THIS ORDINANCE, A FRANCHISE <br />TO CONSTRUCT, OPERATE AND MAINTAIN A CABLE TELE- <br />VISION SYSTEM IN THE STREETS OF NORTH OLMSTED, OHIO; <br />PROVIDING FOR THE REGULATION OF SAID FRANCHISE: AND <br />PROVIDING FOR PAYMENT TO THE CITY FOR THE PRIVILEGE <br />OF SAID FRANCHISE, AS AMENDED. <br />WHEREAS, the Council of the City of North Olmsted has found <br />and determined that the public necessity and convenience would be <br />served by the installation and maintenance of a cable television <br />system within the City; and <br />WHEREAS, the Council has thoroughly studied the possibilities <br />of awarding a franchise to construct, operate, and maintain such a <br />system; and <br />WHEREAS, the Council has concluded full and open public hear- <br />ings on July 1, 1980 , after public notice of such hearings <br />was duly published on June 25, 1980 during which any and <br />all applicants, interested parties, and members of the public de- <br />siring to make application for or present statements concerning <br />the grant of a cable television franchise, were afforded an op- <br />portunity to do so; and the legal, character, financial, technical <br />or other qualifications and adequacy and feasibility of the con- <br />struction arrangements of all applicants were fully considered, <br />and the qualifications and construction programs and proposals of <br />were approved; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, Ohio, that: <br />SECTION 1: CRITERIA <br />PROPOSALS shall be evaluated on the basis of the character, <br />financial, and technical competence and past record of the ap- <br />plicant. In addition, the franchising authority will consider: <br />(a) System capability. <br />(b) Production facilities and services available to local <br />government and nonprofit institutions. <br />(c) Provisions for program telecasting for neighborhoods, <br />civic and public affairs. <br />(d) Facilities and personnel allocated to service customer <br />complaints. <br />(e) Commitment to immediate development of the entire <br />franchising area. <br />(f) Experience of employees. <br />(g) Reasonableness of rate schedules. <br />(h) Equal employment practices. <br />(i) Public interest. <br />(j) Public access to facilities. <br />While these are the basic factors that will be considered in <br />the awards to be made under these proceedings, the franchising <br />agent reserves the right to consider all other factors which are <br />relevant in determining the public interest, convenience, and ne- <br />cessity which would be served by each of the applicants considered. <br />
