PETRIGAC <br />AN ORDINANCE AMENDING CHAPTER 351 OF THE <br />TRAFFIC CODE OF THE CITY OF NORTH OLMSTED <br />ENTITLED "PARKING GENERALLY"BY THE ADDING <br />THERETO OF A NEW SECTION 351.19 ENTITLED <br />"PARKING ON THE BERA4 OF A ROADWAY". <br />WHEREAS, a number of citizens have expressed concern with <br />respect to their inability to utilize the berm of the roadway for <br />parking where there is no curbing, and <br />WHEREAS, it is the understanding of this Council that on <br />occasion individuals have been ticketed for parking on the berm <br />because of the prohibition under Section 351.03 (t), and <br />WHEREAS, it is the desire of this Council to clarify the <br />rights, duties, and obligations of individuals wishing to park on <br />the berm of a roadway where no curbing exists. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Chapter 351 of the Traffic Code of the City <br />of Nort Olmste is hereby amended by adding thereto a new section, <br />namely, Section No. 351.19, which new section shall read as follows: <br />"351.19 PARKING ON BERM OF ROADWAYS WHERE NO CURBING <br />EXISTS. <br />No person shall park or permit to stand a vehicle <br />on the berm of any roadway where the parking of same <br />will obstruct the traveled portion of the street, <br />roadway, or highway. Notwithstanding any other <br />provisions of this Traffic Code, it shall not be <br />considered a violation of the Traffic Code, when a <br />person parks a motor vehicle on the berm of a roadway, <br />which berm is of such a nature that no curbing exists <br />and the parking of said vehicle shall be between the <br />sidewalk and the roadway." <br />SECTION 2: That this Ordinance does hereby repeal any ordinance <br />or parts o ordinances in conflict herewith. <br />SECTION 3: That this Ordinance shall take effect and be in <br />force from and after the earliest period allowed by law. <br />PASSED:_~~~~~ ~~_ /y~l1 <br />ATTEST: <br />/~ . <br />LORENCE CA BELL, C K 0 COUNCIL D W H.
