.,_ ~ __...~.~.4..-.._._... _ _ _ _~...~.._ <br />_ .... <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2009 -136 <br />BY: Mayor O'Grady and Council Member Jones: <br />AN ORDINANCE AMENDING THE TRAFFIC CONTROL FILE OF THE <br />CITY OF NORTH OLMSTED FOR A DO NOT BLOCK INTERSECTION <br />SIGN FOR SOUTH BOUND STEARNS ROAD BEFORE HASTINGS FOR <br />HASTINGS INTERSECTIONAND DECLARING AN EMERGENCY. <br />WHEREAS, the Service Director, following study and review, has found and determined that a safety <br />issue exists at the intersection for south bound Stearns Road before Hastings for the Hastings intersection; and <br />WHEREAS, the intersection is currently blocked during rush hour every weekday; and <br />WHEREAS, this Council, based upon those findings, has determined that it is in the best interest of the <br />safety, health and welfare of the citizens of the City of North Olmsted to post a Do Not Block Intersection sign <br />and accordingly, by the adoption of this Ordinance, desires to do so; and <br />WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of the Traffic Control File, <br />which file can be amended only by Ordinance duly adopted by this Council; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, AND THE STATE OF OHIO: <br />SECTION 1: That the Police Department be and is hereby authorized and directed to amend the <br />Traffic Control File of the City of North Olmsted to indicate thereon the installation of a Do Not Block <br />Intersection sign (sign RIO-7 of the OMUTCD 2005, Section 2B.45) prohibiting the blocking of the intersection. <br />SECTION 2: That the Mayor be and is hereby authorized to cause an appropriate sign or signs to be <br />installed on southbound Stearns Road in accordance with the provisions of this Ordinance and the Ohio Manual <br />of Uniform Traffic Control Devices. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the preservation of the public health, safety and welfare and for the further reason that it is <br />necessary that this legislation go into effect immediately in order to avoid the blocking of traffic; and further <br />provided that it receives the affirmative vote oftwo-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />PASSED: N~(/(ijljtrX K I ~~~'~_ <br />ATT,~ST.• <br />MARIE GALLO <br />Clerk of Council <br />APPROVED: ~~ l P ~~ <br />MAYOR THOMAS E.
