-~ , <br />~~ <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 -134 <br />BY: Mayor O'Grady and Council Member Barker <br />A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF <br />THE CITY, TO ENTER INTO A REVENUE-GENERATING <br />CONTRACT WITH THE COCA-COLA BOTTLING COMPANY TO <br />PROVIDE FOR BEVERAGE VENDING SERVICES AT ALL CITY <br />OF NORTH OLMSTED FACILITIES, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, in accordance with Section 111.01 of the Codified Ordinances, the <br />Director of Community Life Services advertised for proposals from vendors to provide <br />for beverage vending services at all City of North Olmsted facilities; and <br />WHEREAS, proposals were received and reviewed by the Director of <br />Community Life Services and the Parks and Recreation Commissioner; and <br />WHEREAS', the Board of Control, at its November 3, 2009 meeting, reviewed the <br />proposals received by the Director of Community Life Services, and following that <br />review recommended that a contract be awarded to the Coca-Cola Bottling Company to <br />provide beverage vending services at all City of North Olmsted facilities; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a <br />contract with the Coca-Cola Bottling Company as the Official Beverage Supplier of the <br />City of North Olmsted as recommended by the Board of Control; <br />NOW THEREFORE, BE IT RESOLVED B Y THE COUNCIL OF THE CIT Y <br />OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That this Council hereby authorizes the Mayor to execute. on <br />behalf of the City, a contract with the Coca-Cola Bottling Company to provide for <br />beverage vending services at all City of North Olmsted facilities. The contract shall be in <br />a form and substance substantially similar to the current Contract for Services attached <br />hereto as Exhibit A, with changes in revenues that reflect the proposal by the Coca-Cola <br />Bottling Company and such other changes as are not substantially adverse to the City and <br />which are approved by the Director of Law. The character of any such changes as not <br />being substantially adverse to the City shall be evidenced conclusively by the execution <br />of the agreement by the Mayor and the approval of the agreement by the Director of Law. <br />
