s.. ~,; <br />4 ~ <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 131 <br />BY: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO <br />AN AGREEMENT WITH UNIVERSITY HOSPITALS OF <br />CLEVELAND THAT WILL PROVIDE FOR THE NORTH OLMSTED <br />POLICE DEPARTMENT TO PARTICIPATE IN THE OHIO <br />DEPARTMENT OF PUBLIC SAFETY "CLICK IT OR TICKET" AND <br />"OVER THE LIMIT UNDER ARREST" OVERTIME PROJECT, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, University Hospitals of Cleveland ("UHC") has received a Cuyahoga <br />County "Click it or Ticket" and "Over the Limit Under Arrest" Overtime Grant from the Ohio <br />Department of Public Safety; and <br />WHEREAS, UHC proposes to enter into an Agreement with the City of North Olmsted <br />that would provide for the North Olmsted Police Department to participate in the "Click it or <br />Ticket" and "Over the Limit Under Arrest" Overtime Project funded by the above Grant; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into an <br />Agreement. with UHC that would provide for the North Olmsted Police Department to participate <br />in said Project; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />.'NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and is hereby authorized to enter into an Agreement <br />with University Hospitals of Cleveland ("UHC") providing for the North Olmsted Police <br />Department to participate in the Ohio Department of Public Safety "Click it or Ticket" and "Over <br />the Limit Under Arrest" Overtime Project. The Agreement, styled as a "Contract -University <br />Hospitals of Cleveland Services Agreement" shall be substantially in the form of the document <br />attached to this Resolution and marked as "Exhibit A," with only such changes therein as are not <br />substantially adverse to the City and which are approved by the Mayor and the Director of Law. <br />The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of this <br />City and for the further reason that this Resolution is required to be immediately effective so that <br />the City be allowed immediate participation in the Project; and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />
