s.. ~,; 4 ~ CITY OF NORTH OLMSTED RESOLUTION NO. 2009 - 131 BY: Mayor O'Grady A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH UNIVERSITY HOSPITALS OF CLEVELAND THAT WILL PROVIDE FOR THE NORTH OLMSTED POLICE DEPARTMENT TO PARTICIPATE IN THE OHIO DEPARTMENT OF PUBLIC SAFETY "CLICK IT OR TICKET" AND "OVER THE LIMIT UNDER ARREST" OVERTIME PROJECT, AND DECLARING AN EMERGENCY. WHEREAS, University Hospitals of Cleveland ("UHC") has received a Cuyahoga County "Click it or Ticket" and "Over the Limit Under Arrest" Overtime Grant from the Ohio Department of Public Safety; and WHEREAS, UHC proposes to enter into an Agreement with the City of North Olmsted that would provide for the North Olmsted Police Department to participate in the "Click it or Ticket" and "Over the Limit Under Arrest" Overtime Project funded by the above Grant; and WHEREAS, it is the desire of this Council to authorize the Mayor to enter into an Agreement. with UHC that would provide for the North Olmsted Police Department to participate in said Project; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF .'NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and is hereby authorized to enter into an Agreement with University Hospitals of Cleveland ("UHC") providing for the North Olmsted Police Department to participate in the Ohio Department of Public Safety "Click it or Ticket" and "Over the Limit Under Arrest" Overtime Project. The Agreement, styled as a "Contract -University Hospitals of Cleveland Services Agreement" shall be substantially in the form of the document attached to this Resolution and marked as "Exhibit A," with only such changes therein as are not substantially adverse to the City and which are approved by the Mayor and the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare, of this City and for the further reason that this Resolution is required to be immediately effective so that the City be allowed immediate participation in the Project; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
