Family member shall mean: Brother or sister of spouse, grandparents, grandparents of spouse, <br />grandchild as well as any relative living in the employee's home. <br />15.05 Bereavement leave shall be exclusive of sick time or any other accumulated time. <br />ARTICLE 16 GRIEVANCE PROCEDURE <br />16.01 The term "grievance" shall mean an allegation by a bargaining unit employee that there <br />has been a breach, misinterpretation, or improper application of this agreement. <br />16.02 A grievance may be filed by any member of the bargaining unit. Where a group of <br />bargaining unit members desire to file a grievance involving a situation affecting more than one <br />member of the bargaining unit in a similar manner, one member selected by such a group shall <br />process the grievance. Such grievance shall be defined as a group grievance. The names of each <br />member, on behalf of which the grievance is filed, shall be made available at the first hearing. <br />Group grievances shall be presented in the first instance to the supervisor common to all <br />employees in the group. The grievance procedure outlined in Section 16,05 shall be used <br />tlu•oughout. <br />16.03 All grievances must be processed and answered at the proper step in the grievance <br />progression to be considered at the next step. Any grievance that is not timely appealed to the <br />next step of the procedure, will be deemed to have been settled on the basis of the Employer's <br />a~lswer at the last completed step. <br />Time limits set forth herein may only be extended by mutual agreement of the parties. <br />The aggrieved may withdraw a grievance at any point by submitting, in writing, a statement to <br />that affect, or by permitting the time requirements at any step to lapse without fiu-ther appeal. <br />Any grievance not answered by the Employer or his designee within the stipulated time limits <br />shall be considered to have been appealed to the next step in the grievance procedure. <br />16.04 Written grievances must be filed on the form provided by the FOP and shall contain, but <br />not be limited to, the following information. <br />1. Date and time grievance occurred; <br />2. Description of incident giving rise to the grievance; <br />3. Articles and sections of the agreement involved; <br />4. Relief requested; <br />5. Signature of the employee. <br />16.05 The following steps shall be followed in the processing of a grievance. <br />Step 1. Within five (5) working days of the incident or lalowledge of the incident (but in <br />no case later than fifteen (15) calendar days from the actual facts which give rise to the <br />grievance, the aggrieved employee shall submit his written grievance to the Shift Lieutenant, or <br />his designee, who shall indicate the date and time of receipt of the grievance, and affix his <br />]o <br />
