leaves of absence from their respective positions without loss of pay for the time they are <br />performing service in the uniformed services, for periods of up to one month, for each calendar <br />year in which they are performing service in the uniformed services. In addition, this Article is <br />not intended to supplant any other military leave benefit to which members may be entitled <br />pursuant to any other section of the Ohio Revised Code. <br />ARTICLE 30 IN-SERVICE TRAINING PAY <br />30.01 Each member of the bargaining unit shall receive in-service training pay annually in the <br />amount of four hundred dollars ($400.00), provided that (a) the member maintained his or her in- <br />service training requirements in the prior year, and (b) the Employer, during all or any portion of <br />the prior year, employed no more than two full-time corrections officers in the police <br />department. <br />30.02 Notwithstanding the provisions of paragraph 30.01 no payments will be due, owing or <br />paid during the calendar years 2010 and 2011. <br />ARTICLE 31 DRUG TESTING WITH BWC <br />31.01 For the purpose of implementing the provisions of this article, each bargaining unit <br />member shall execute medical releases in order for the City to obtain the results of the <br />examinations/drug screen testing provided for in this Article and the City's Drug Testing <br />Procedures per the City of North Olmsted Drug Free Workplace Policy. <br />31.02 The drug testing policy shall be the drug free workplace plans established by the Bureau <br />of Workers' Compensation (BWC). It is further agreed to by the FOP and the Employer that <br />only BWC Level 1 Drug Free Workplace Policy will be implemented by the parties, without <br />random drug testing. <br />31.03 If an employee is required to submit a written report, they shall be advised of the reason <br />for such report. <br />31.04 In the event that disciplinary action is taken against a member, the member shall have the <br />right to request the presence of a FOP representative when such action is taken. <br />31.05 If all the screening and confirmatory tests are positive, the City shall require the <br />employee to participate in a rehabilitation or detoxification program, as determined by <br />appropriate medical personnel. The cost of the program will be covered b the employee's health <br />insurance plan or the Employer. <br />31.06 An employee who participates in a rehabilitation or detoxification program shall be <br />allowed to use sick leave, vacation leave, or personal days for the period of the rehabilitation. If <br />no such leave credit is available, such employee maybe placed on an unpaid medical leave of <br />absence. <br />20 <br />
