MEMORANDUM OF UNDERSTANDING <br />It is hereby agreed by and between the City of North Olmsted (Employer) and the Ohio Council <br />8, Local 2681, AFSCME that in full resolution of all outstanding issues between the Employer <br />and AFSCME for a successor collective bargaining agreement (CBA) the following shall be <br />implemented. <br />2 <br />4. <br />6 <br />7 <br />The hours reduction from forty (40) hours per week to thirty-six and one quarter (36 <br />'/4) bolus per week shall commence at the beginning of the fourth frill pay period in <br />2010 (2/13/2010) and continue for ninety-two (92) consecutive weeks (concluding <br />11/18/1011), when the work week shall revert to forty (40) hours per week starting <br />11/19/1011. All employees working this reduced work week shall continue to be full <br />time employees. <br />Vacation time shall be earned on a weekly basis and taken off on a weekly basis (e.g. <br />before 2/13/2010 - 40 hrs. equals one week and on 2/13/2010 and after until <br />1 1/1 81201 1 - 36 '/4 hours equals a week). Vacation trine previously earned and <br />carried over prior to 2/13/2010 shall be paid at the forty (40) hour week rate upon an <br />employee's retirement. <br />Holiday time shall be based on the hours of work the employee is working at the time <br />of the holiday. <br />Siclc leave is accrued based on the number of hours worked per week and utilized at <br />the number of hours the employee is scheduled to work but takes off on sick leave. <br />A Labor-Management meeting will be scheduled to address shift scheduling and <br />lunch period in the Waste Water Treatment Plant and starting and quitting times in <br />the Service Department generally. <br />Articles 9 and 10 shall be aanended effective January 1, 2010 to provide for athirty- <br />six and one quarter (36 '/4) hour work week, which shall continue tlu•ough December <br />31, 2011. Payment for overtime at one and one half (1 '/2) time shall be made for all <br />work over forty (40) hours in a work week. <br />Hours of work per day shall be seven and one quarter (7 '/4) hours, with a starting and <br />quitting time of 7:00 a.m. and 2:45 pm. Where applicable during January, 2010 to <br />December 31, 2011 for WWTP Systems, WWTP Sludge Hauler, WWTP <br />Maintenance, WWTP Lab, Service, Fleet and Building Maintenance. <br />Vacation, sick leave, holiday time and sick leave bonus days shall be calculated, <br />earned and accumulated on the new work week and used bases of the 36 '/4 work <br />week. <br />9. Vacation may not be sold back and sick leave bonus days may only be taken as time <br />off and not cash from January 1, 2010 to December 31, 2011. <br />10. The AFSCME healthcare premium shall be increased by $7.00 per month, effective <br />January 1, 2010. <br />11. Wage rates shall remain as is for the duration of the labor contract, with a wage <br />reopened in April, 2011 for wage rates effective July 1, 2011. <br />12. All other provisions of the CBA shall remain in full force and effect, with all other <br />proposals not addressed in this document being withdrawn. <br />
