<br /> <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 -111 <br />BY: Mayor Thomas O'Grady <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO PREPARE AND SUBMIT ANAPPLICATION FOR STATE <br />OF OHIO ISSUE 1 FUNDING FOR THE PORTER ROAD WATER <br />MAIN REPLACEMENT PROJECT AND FURTHER FOR THE MAYOR <br />TO ACCEPT, ON BEHALF OF THE CITY, SAID FUNDING IF <br />AWARDED, SUBJECT TO ALL TERMS AND CONDITIONS, <br />INCLUDING THE CITY'S PORTION OF COSTS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Porter Road is a County Road (C.R. 164) located within the boundaries of <br />the City of North Olmsted; and <br />WHEREAS, The Cuyahoga County Engineer's Office and the City of North Olmsted are <br />desirous of making application to the State of Ohio for Issue 1 funding in connection with the <br />Porter Road Water Main Replacement Project; and <br />WHEREAS, the City of North Olmsted has agreed with the Cuyahoga County Engineer's <br />Office to make application to the State of Ohio for Issue 1 funding on behalf of the Cuyahoga <br />County Engineer's Office and the City of North Olmsted in connection with the Porter Road <br />Water Main Replacement Project; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service is hereby authorized to prepare and <br />submit an application to the Ohio Public Works Commission for Issue 1 funding for the <br />proposed Porter Road Water Main Replacement Project and the Mayor to accept, on behalf of <br />the City, said funding if awarded, subject to all terms and conditions, including the City's portion <br />of costs; and to execute all contracts and other documents and do all things necessary in <br />furtherance thereof. <br />SECTION 2: That, if such application is approved, it is the intent of this Council to pay <br />for this City's portion of the costs in connection with such project therewith. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that the preparation and submission of the application for funding is immediately <br />necessary in order to meet the deadline for Issue 1 applications; and further provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />
