CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 - 108 <br />BY: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MAYOR, ON BEHALF OF <br />THE CITY OF NORTH OLMSTED, TO ENTER INTO AN <br />AGREEMENT WITH THE OLMSTED HISTORICAL SOCIETY <br />GRANTING THE LATTER PERMISSION TO PLACE COMMUNITY <br />EVENT BANNERS ONPOLES LOCATED IN THE CITYRIGHT-OF- <br />WAY AT EXISTING CITY BANNER LOCATIONS, AND <br />DECLARING AN EMER GENCY. <br />WHEREAS, it is the desire of the Olmsted Historical Society to place community <br />event banners on designated Cleveland Electric Illuminating Company ("CEI") poles <br />located in the City right-of--way at existing City banner locations in order to advertise the <br />Olmsted Historical Society's events at the Frostville Museum; and <br />WHEREAS, the Mayor and the Director of Planning support this project; and <br />WHEREAS, it is the desire therefore of this Council to accordingly authorize the <br />Mayor to enter into an Agreement with the Olmsted Historical Society granting it <br />permission to place banners on CEI poles in the right-of--way at existing City banner <br />locations; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into an Agreement with the Olmsted Historical Society <br />permitting the latter to place banners on designated CEI poles located in the City right-of- <br />way at existing City banner locations. Said Agreement shall be substantially in the form <br />as the Agreement attached hereto as Exhibit A, with only such changes therein as are not <br />substantially adverse to the City and which are approved by the Mayor and the Director <br />of Law. The character of any such changes as not being substantially adverse to the City <br />shall be evidenced conclusively by the execution of the Agreement by the Mayor and the <br />approval of the Agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reason that the Agreement must go into effect immediately <br />because the Community event runs from October 2 through October 31, 2009, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
