mss,. <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 103 <br />BY: Council Member Mahoney <br /> <br />A RESOLUTION CANCELING THE CURRENT AGREEMENT, AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A NEW <br />AGREEMENT, WITH THE NORTH OLMSTED SCHOOL DISTRICT <br />GRANTING THE SCHOOL DISTRICT A LICENSE TO INSTALL <br />AND MAINTAIN A REMO VABLE FENCE ON DIAMOND NUMBER <br />ONE BASEBALL FIELD AT NORTH OLMSTED PARK, AS <br />A MF, NnF, n. <br />WHEREAS, this Council previously adopted Resolution 2006-04 on February 21, <br />2006, authorizing the Mayor to enter into a license agreement with the North Olmsted <br />School District providing for the installation of a removable fence on Diamond Number <br />One Baseball Field at North Olmsted Park; and <br />WHEREAS, under the current Agreement authorized by said Resolution, the <br />removable fence has interfered with certain activities of the Boy Scouts and Girl Scouts, <br />as well as the North Olmsted Soccer Organization ("NOSO"); and <br />WHEREAS, it is accordingly the desire of this Council to cancel the current <br />license agreement with the North Olmsted School District, and provide authorization for <br />a new license agreement to install a removable fence on Diamond Number One Baseball <br />Field at North Olmsted Park for the use of North Olmsted school baseball teams, with <br />provision requiring that the removable fence be taken down ~++~,o o.,a ,.~o.,,.~, ~„~,~...~ <br />no later than by July 31 each year and that school representatives <br />take down and nut up the fence, as needed each near, to accommodate participants <br />in the annual All Scouts Weekend and the NOSO Cup; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the License Agreement entered into between the City of North <br />Olmsted and the North Olmsted School District pursuant to the authority granted by <br />Resolution 2006-04 of this Council is hereby terminated and canceled. <br />SECTION 2: That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into a new Agreement with the North Olmsted School <br />District, again granting to the latter a license to install and maintain a removable fence on <br />Diamond Number One Baseball Field at North Olmsted Park, in accordance with the <br />plans and specifications previously provided to the Parks and Recreation Commissioner. <br />SECTION 3: That the agreement between the City of North Olmsted and the <br />North Olmsted School District shall be in the same form and contain the same substantive <br />
