<br /> <br />REVOCABLE LICENS ,AGREEMENT <br />THIS AGREEMENT, made at North Olmsted, Ohio, this day of , 2009, <br />by and between the City of North Olmsted, an Ohio municipal corporation ("City"), and the North <br />Olmsted School District, an Ohio School District ("School District"); <br />WHEREAS, the School District has requested the City grant it permission to install, maintain <br />and (if so directed) remove a removable fence on Diamond Number One Baseball Field at North <br />Olmsted Park, in accordance with the plans and specifications provided to the Recreation <br />Commissioner; and <br />WHEREAS, City Council adopted Resolution 2009-103, on , 2009, <br />authorizing the Mayor to enter into an Agreement with the School District that would provide a <br />license to the School District to install and maintain such a fence on Diamond Number One; and <br />WHEREAS, the parties desire to and by these presents intend to delineate and determine the <br />rights, obligations, duties and liabilities of each; <br />NOW THEREFORE, in consideration of the foregoing premises and the mutual promises <br />hereinafter set forth, the parties agree as follows: <br />1. City grants the School District a limited revocable license to install and maintain, at <br />its sole expense, a removable fence on Diamond Number One Baseball Field at North Olmsted Park, <br />in accordance with the plans and specifications previously provided to the Recreation Commissioner, <br />commencing upon the date of execution of this Agreement by the City and School District. <br />2. This Revocable License Agreement shall continue in effect from year to year until <br />such time as the City, for any reason whatsoever, shall terminate the license. In the event of such <br />action, the City shall give the School District thirty (30) days notice to remove the fence, during <br />which time the School District shall, at its sole cost, remove the fence and restore the site to its pre- <br />license condition. If, for any reason, the School District should fail to comply with the directive of <br />the City within the thirty (30) day period, then the City may, on its own, remove the fence, restore the <br />premises to pre-license condition, and charge the City's reasonable expenses thereof to the School <br />District. <br />3. The School District agrees that it shall, for each year that this license is in effect, <br />provide the City with advance written notice of the beginning and ending dates of its baseball season, <br />and shall thereafter install and take down the fence on the dates that are in turn provided to the <br />School District for installation and take down by the City's Recreation Commissioner.
