BY: Mayor O'Grady <br />AN ORDINANCE AMENDING ORDINANCE NO. 98-149, SO <br />AS TO EXPAND THE AUTHORITY OF THE CITY'S <br />COMMUNITY DIVERSION PROGRAM (CDP), IN ORDER TO <br />INCREASE THE OPPORTUNITY FOR PROGRAM <br />PARTICIPATION BY DIVERSION OF CERTAIN TRAFFIC <br />VIOLATIONS IN COOPERATION WITH THE CUYAHOGA <br />COUNTY JUVENILE COURT. <br />WHEREAS, the City of North Olmsted has, since the establishment of the Community <br />Diversion Program (CDP) pursuant to Ordinance 1998-149, successfully cooperated with the <br />Cuyahoga County Juvenile Court to divert specified juvenile delinquency and unruly charges <br />for review and intervention by the Volunteer Magistrate and the City's Youth Development <br />Program (YDP), as administered by Chris Allegra first offenders; <br />WHEREAS, the Cuyahoga County Juvenile Court may provide for an increase in the <br />opportunity for participation in the City's CDP upon expansion of its authority to accept <br />diversion of certain traffic violations, particularly "waiverable" infractions committed by first- <br />time juveniles offenders; and <br />WHEREAS, it is the desire of Council, upon the recommendation of the Director of <br />Public Safety and the YDP Administrator, to expand the authority of the CDP to accept <br />diversion of certain traffic violations, in cooperation with the Cuyahoga County Juvenile <br />Court, and to thereby increase opportunity for participation in diversion; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 3 of Ordinance No. 98-149, which presently reads as <br />follows: <br />"SECTION 3: That these Volunteer Magistrates shall hear and pronounce disposition <br />on all complaints involving minor first time delinquency and unruly offenses committed <br />by minor North Olmsted City youth which are referred by the City of North Olmsted <br />Police Department. " <br />
