<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 - 90 <br />By: Mayor O'Grady and Council Members Orlowski, Barker, Jones and Kearney <br />A RESOLUTION AUTHORIZING THE ADMINISTRATION TO APPLY <br />FOR, AND THE MAYOR TO ACCEPT AND ENTER INTO, A WATER <br />POLLUTION CONTROL LOAN FUND AGREEMENT ON BEHALF OF <br />THE CITY OF NORTH OLMSTED FOR THE REPAIR AND/OR <br />REPLACEMENT OF HOME SEWAGE TREATMENT SYSTEMS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted seeks to repair and/or replace existing home <br />sewage treatment systems; and <br />WHEREAS, the City of North Olmsted has applied for assistance from the American <br />Recovery and Reinvestment Act of 2009 through the Water Pollution Control Loan Fund <br />(WPCLF) for the repair and/or replacement of home sewage treatment systems; and <br />WHEREAS, the Ohio Water Pollution Control Loan Fund requires the government <br />authority to pass legislation for application of a loan and the execution of an agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City Administration is authorized to apply for a Water Pollution <br />Control Loan Fund (WPCLF) loan, and the Mayor is authorized to sign all documents for and to <br />enter into a Water Pollution Control Loan Fund Agreement with the Ohio Environmental <br />Protection Agency and the Ohio Water Development Authority for the repair and/or replacement <br />of home sewage treatment systems on behalf of the City of North Olmsted, Ohio. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately due to <br />timeline requirements of the State; and further provided it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />
