,, <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 - 74 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF <br />THE CITY OF NORTH OLMSTED, TO ENTER INTO AN <br />AGREEMENT WITH THE NORTH OLMSTED COMMUNITY <br />COUNCIL, INC., GRANTING THE LATTER PERMISSION TO <br />PLACE HOMECOMING BANNERS ON POLES LOCATED IN THE <br />CITY RIGHT-OF-WAY ON LORAIN ROAD NEAR NORTH <br />OLMSTED PARK, AND DECLARING AN EMERGENCY. <br />WHEREAS, it is the desire of the North Olmsted Community Council, Inc. <br />[hereinafter, the "Community Council"] to place banners on designated Cleveland <br />Electric Illuminating Company ("CEI") poles located on Lorain Road near North <br />Olmsted Park in order to promote the annual Homecoming Event; and <br />WHEREAS, the Mayor and the Directors of Public Service and Planning support <br />this Community Council project; and <br />WHEREAS, it is the desire therefore of this Council to accordingly authorize the <br />Mayor to enter into an Agreement with the Community Council granting it permission to <br />place Homecoming banners on CEI poles in the right-of--way on Lorain Road near the <br />North Olmsted park and to provide for the City's participation in the said project; <br />NO W THEREFORE, BE IT RESOL VED B Y THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into an agreement with the North Olmsted Community <br />Council, Inc. permitting the latter to place Homecoming banners on designated CEI poles <br />located in the City right-of--way on Lorain Road near North Olmsted Park and providing <br />for the City's participation in the project. Said agreement shall be substantially in the <br />form as the Agreement attached hereto as Exhibit A, with only such changes therein as <br />are not substantially adverse to the City and which are approved by the Mayor and the <br />Director of Law. The character of any such changes as not being substantially adverse to <br />the City shall be evidenced conclusively by the execution of the agreement by the Mayor <br />and the approval of the agreement by the Director of Law. <br />
