,, CITY OF NORTH OLMSTED RESOLUTION N0.2009 - 74 BY: Mayor O'Grady A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF THE CITY OF NORTH OLMSTED, TO ENTER INTO AN AGREEMENT WITH THE NORTH OLMSTED COMMUNITY COUNCIL, INC., GRANTING THE LATTER PERMISSION TO PLACE HOMECOMING BANNERS ON POLES LOCATED IN THE CITY RIGHT-OF-WAY ON LORAIN ROAD NEAR NORTH OLMSTED PARK, AND DECLARING AN EMERGENCY. WHEREAS, it is the desire of the North Olmsted Community Council, Inc. [hereinafter, the "Community Council"] to place banners on designated Cleveland Electric Illuminating Company ("CEI") poles located on Lorain Road near North Olmsted Park in order to promote the annual Homecoming Event; and WHEREAS, the Mayor and the Directors of Public Service and Planning support this Community Council project; and WHEREAS, it is the desire therefore of this Council to accordingly authorize the Mayor to enter into an Agreement with the Community Council granting it permission to place Homecoming banners on CEI poles in the right-of--way on Lorain Road near the North Olmsted park and to provide for the City's participation in the said project; NO W THEREFORE, BE IT RESOL VED B Y THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he is hereby authorized to enter into an agreement with the North Olmsted Community Council, Inc. permitting the latter to place Homecoming banners on designated CEI poles located in the City right-of--way on Lorain Road near North Olmsted Park and providing for the City's participation in the project. Said agreement shall be substantially in the form as the Agreement attached hereto as Exhibit A, with only such changes therein as are not substantially adverse to the City and which are approved by the Mayor and the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
