<br />,~ <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2009 - 72 <br />BY: Council Member Orlowski and Council Members Barker and Dailey Jones <br />AN ORDINANCE CREATING NEW CHAPTER 1373 OF THE <br />BUILDING CODE, ENTITLED "BUILDING, ZONING, PROPERTY <br />MAINTENANCE AND OTHER NUISANCE ACTIVITIES," IN <br />ORDER TO PROVIDE FOR THE ABATEMENT OF PUBLIC <br />NUISANCES AND THE RECOVERY OF CITY RESPONSE COSTS <br />INCURRED AS THE RESULT OF THE MULTIPLE RECURRENCE <br />OF SUCH NUISANCE ACTIVITIES ON RESIDENTIAL PROPERTY <br />LOCATED IN THE CITY OF NORTH OLMSTED. <br />WHEREAS, public nuisance activities conducted in residential neighborhoods o~ <br />the City of North Olmsted adversely affect the health, safety and welfare of residents and <br />property owners in the City of North Olmsted; and <br />WHEREAS, such public nuisance activities, particularly when they are permitted <br />to continue or recur on residential properties within the City of North Olmsted, negatively <br />affect property values in and the livability and vitality of the City's residential <br />neighborhoods, as well as the quality of life for individual residents in the City; and <br />WHEREAS, such public .nuisance activities, if ignored or left unaddressed, lead <br />to the deterioration of neighborhoods and the flight of responsible homeowners from the <br />City; and <br />WHEREAS, the City accordingly has an obligation and a duty to abate such <br />public nuisances in an effective way in order to protect the health, safety and welfare of <br />the City's residents and property owners; and <br />WHEREAS, owners of property who create, maintain, permit or otherwise suffer <br />to exist public nuisances on their property .located within the City of North Olmsted on <br />multiple occasions cause the City to expend out of the ordinary general fund resources, in <br />the form of multiple safety and/or service department responses, in order to abate such <br />nuisances; and <br />WHEREAS, this Council has received and reviewed information and reports from <br />the Department of Public Safety regarding the specific costs incurred by the City in <br />responding on multiple occasions to the same residential property in the City in order to <br />address building and zoning code violations and/or property maintenance nuisance <br />activities; and <br />
