,mow <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 65 <br />By: Mayor O'Grady <br /> <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF LA W TO SETTLE A <br />CLAIM FOR DAMAGES TO A POLICE CRUISER AND AUTHORIZING <br />THE MAYOR TO EXECUTE A GENERAL RELEASE AND SETTLEMENT. <br />WHEREAS, on December 8, 2007 police cruiser #5210 owned by the City of North <br />Olmsted was involved in a collision at the intersection of Great Northern Boulevard and <br />Brookpark Road; and <br />WHEREAS, after extensive negotiations, Erie Insurance has offered to settle the City <br />claim for Fifty Percent (50%) of the total loss on the police cruiser ($11,225.00) plus Fifty <br />Percent (50%) of the salvage value ($1,403.12) plus One Hundred Percent (100%) of the special <br />equipment damage ($7,693.00) for a total payment to the City of North Olmsted in the amount of <br />$20,321.12 in exchange for the City's execution of a General Release of all claims against <br />Sharon Deaton; and <br />WHEREAS, the Director of Law recommends the settlement of this claim based upon all <br />of the facts and circumstances surrounding the subject collision; and <br />WHEREAS, it is the desire of this Council, based upon the recommendation of the <br />Director of Law, to authorize him to settle the claim as proposed and to authorize the Mayor to <br />execute the settlement and release documents; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Law be and he is hereby authorized to settle the <br />City's claim against Sharon Deaton and Erie Insurance for damages to police cruiser #5210 <br />arising out of a collision that occurred on December 8, 2007, as above described, in the total <br />amount of Twenty Thousand Three Hundred and Twenty-One Dollars and Twelve Cents <br />($20,321.12) and a general release from the said Sharon Deaton and further that the Mayor is <br />authorized to execute a General Release and Settlement Agreement and Mutual Release of <br />Property Damage Claims on behalf of the City in the said matter in substantially the same form <br />as attached hereto as Exhibit A and B respectively. <br />
