CITY OF NORTH OLMSTED ORDINANCE N0.2009 - 60 BY: Mayor O'Grady AN ORDINANCE AUTHORIZING THE MAYOR TO RENEW THE CONTRACT BETWEEN THE CITY AND KARRIE SKALL TIPTON FOR THE PROVISION OF PROFESSIONAL GYMNASTICS INSTRUCTION SERVICES AT THE NORTH OLMSTED RECREATION CENTER FOR ANADDITIONAL TWO (2) YEARS. WHEREAS, Karrie Skall Tipton has, pursuant to a series of contracts authorized by this Council, provided gymnastics program services at the City's Recreation Center since 1999; and WHEREAS, it is the recommendation of the Director of Community Life Services that the current contract between the City and Ms. Tipton be renewed for an additional two-year term, for the period September 1, 2009 through August 31, 2011; and WHEREAS, it is the desire of this Council to dispense with initiating an RFP or RFQ process for said services and to approve and authorize the renewal contract with Ms. Tipton in substantially the form as attached hereto, to provide for the contract to be effective as of September 1, 2009, and to authorize the Mayor to execute said contract; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to execute a renewal contract with Karrie Skall Tipton in substantially the form and substance as evidenced in the Contract Authorization for the Provision of Gymnastic Equipment, Instructions and Related Services to the City of North Olmsted, attached to this Ordinance as "Exhibit A," with only such changes to said contract to be hereinafter made as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreements by the Mayor and the approval of the agreements by the Director of Law. Said Contract shall be for atwo-year term effective September 1, 2009 and, unless further renewed, concluding on August 31, 2011. SECTION 2: That this Ordinance shall take and be in force and effect from and after the earliest period provided for by law.
