CITY OF NORTH OLMSTED <br />ORDINANCE N0.2009 - 60 <br />BY: Mayor O'Grady <br />AN ORDINANCE AUTHORIZING THE MAYOR TO RENEW THE <br />CONTRACT BETWEEN THE CITY AND KARRIE SKALL TIPTON <br />FOR THE PROVISION OF PROFESSIONAL GYMNASTICS <br />INSTRUCTION SERVICES AT THE NORTH OLMSTED <br />RECREATION CENTER FOR ANADDITIONAL TWO (2) YEARS. <br />WHEREAS, Karrie Skall Tipton has, pursuant to a series of contracts authorized <br />by this Council, provided gymnastics program services at the City's Recreation Center <br />since 1999; and <br />WHEREAS, it is the recommendation of the Director of Community Life <br />Services that the current contract between the City and Ms. Tipton be renewed for an <br />additional two-year term, for the period September 1, 2009 through August 31, 2011; and <br />WHEREAS, it is the desire of this Council to dispense with initiating an RFP or <br />RFQ process for said services and to approve and authorize the renewal contract with Ms. <br />Tipton in substantially the form as attached hereto, to provide for the contract to be <br />effective as of September 1, 2009, and to authorize the Mayor to execute said contract; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to execute a <br />renewal contract with Karrie Skall Tipton in substantially the form and substance as <br />evidenced in the Contract Authorization for the Provision of Gymnastic Equipment, <br />Instructions and Related Services to the City of North Olmsted, attached to this <br />Ordinance as "Exhibit A," with only such changes to said contract to be hereinafter made <br />as are not substantially adverse to the City and which are approved by the Director of <br />Law. The character of any such changes as not being substantially adverse to the City <br />shall be evidenced conclusively by the execution of the agreements by the Mayor and the <br />approval of the agreements by the Director of Law. Said Contract shall be for atwo-year <br />term effective September 1, 2009 and, unless further renewed, concluding on August 31, <br />2011. <br />SECTION 2: That this Ordinance shall take and be in force and effect from and <br />after the earliest period provided for by law. <br />
