<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 69 <br />BY: Mayor O'Grady <br />o< # <br />A RESOL UTION AMENDING RESOLUTION NO. 2007-125 WHICH <br />AUTHORIZED THE MAYOR, ON BEHALF OF THE CITY OF <br />NORTH OLMSTED, TO ENTER INTO A CONTRACT WITH THE <br />CITY OF WESTLAKE AND/OR HNTB CORPORATION IN ORDER <br />TO OBTAINA WATER FEASIBILITY STUDY. <br />WHEREAS, this Council, on October 16, 2007, adopted Resolution No. 2007- <br />125 which provided for the City to enter into a contract with either the City of Westlake <br />or HNTB Corporation in order to procure a phase 1 water feasibility study; and <br />WHEREAS, said Resolution No. 2007-125 provided that the City would not <br />expend more than Twenty-Four Thousand Nine Hundred Dollars ($24,900.00) for said <br />phase 1 study; and <br />WHEREAS, as the result of the City of Bay Village declining to participate in <br />said feasibility study, the City of North Olmsted's share of the cost for the feasibility <br />study, as reflected in the contract executed by the City and HNTB Corporation, increased <br />to Thirty Thousand Nine Hundred Fifty Dollars ($30,950.00); and <br />WHEREAS, HNTB Corporation has prepared the phase 1 feasibility study for the <br />City of North Olmsted, -and the City Administration is satisfied with HNTB's <br />performance of its obligations under the said contract; and <br />WHEREAS, it is the desire of this Council, acting upon the request of the Mayor, <br />to amend Resolution No. 2007-125 to permit the Director of Finance to pay the increased <br />amount to HNTB Corporation as reflected in said contract; <br />NOW THEREFORE, BE IT RESOL vED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Section 3 of Resolution No. 2007-125, which currently reads <br />as follows: <br />SECTION 3: That the City's share of the cost for participating in Phase I <br />of the proposed water feasibility study shall not exceed Twenty-four <br />Thousand Nine Hundred Dollars ($24,900.00). <br />
