<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 - 59 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE CUYAHOGA COUNTY PUBLIC <br />LIBRARY TO MAKE STRUCTURAL CHANGES TO THE NORTH <br />OLMSTED LIBRARY BUILDING LOCATED AT 27403 LORAIN ROAD, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the lease between the City of North Olmsted and the Cuyahoga County <br />Public Library ("CCPL") provides that structural modifications to the North Olmsted Library <br />building located at 27403 Lorain Road may not be made by the CCPL without the prior written <br />consent of the City; and <br />WHEREAS, the CCPL proposes to make interior changes to the Library consisting of <br />removing the rubber flooring associated with the oxcart in the children's area and enclosing the <br />oxcart so that it will be a visual exhibit instead of an interactive exhibit. This change is being <br />proposed to alleviate safety concerns over people tripping and falling on the rubber ss.''aty <br />flooring; and <br />WHEREAS, it is the desire of this Council, in the interest of safety at the Library, to <br />consent to the CCPL making the said changes to the Library building as proposed; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That this Council, on behalf of the City of North Olmsted, consents to the <br />Cuyahoga County Public Library ("CCPL") making the following structural change to the North <br />Olmsted Library at 27403 Lorain Road: removing the rubber flooring associated with the oxcart <br />in the children's area of the Library and enclosing the oxcart so that it will be a visual exhibit <br />instead of an interactive exhibit. The said changes shall be made in according with the sketches <br />attached to this legislation as Exhibits 1, 2 and 3. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that it is necessary that this Resolution go into effect immediately because of child safety <br />concerns, and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: , ~-,~.e ~~ ~-e~o First Reading: ~ 6 G <br />~s` Second Reading: ~ <br />`f Third Readin -*C. <br />Committee: ~ .~ u~~- ~ ~` ~~``~° <br />~. <br />
