<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 53 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE PAYMENT OF FIVE THOUSAND <br />NINE HUNDRED TWENTY-FOUR DOLLARS AND FOURTEEN CENTS <br />($5,924.14) TO RELIANCE MECHANICAL FOR REPAIR WORK DONE TO <br />THE POOL APR UNIT AND MUNTERS UNIT AT THE NORTH OLMSTED <br />RECREATION CENTER, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Recreation Department was in need of repair work on the pool APR unit <br />and Munters unit; and <br />WHEREAS, at the time, sufficient funds had been appropriated by this Council and were <br />on hand to pay for said repair work in the amount of Five Thousand Nine Hundred Twenty-Four <br />Dollars and Fourteen Cents ($5,924.14); and <br />WHEREAS, through inadvertence, a purchase order certifying that funds had been <br />appropriated and were on hand to pay the invoice, and authorizing payment of this invoice, was <br />not requested from the Director of Finance until March 31, 2009 after repairs had been begun; <br />and <br />WHEREAS, pursuant to R.C. Section 5705.41(D), payment to Reliance Mechanical, <br />pursuant to the purchase order requested may not be made by the Director of Finance until <br />authorized by this Council; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Finance to pay to <br />Reliance Mechanical for the repair of the pool APR unit and Munters unit the agreed contract <br />price of Five Thousand Nine Hundred Twenty-Four Dollars and Fourteen Cents ($5,924.14); and <br />NOW, THEREFORE, BE IT RESOLVED B Y THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Finance be, and she hereby is, authorized to pay to <br />Reliance Mechanical the sum of Five Thousand Nine Hundred Twenty-Four Dollars and <br />Fourteen Cents ($5,924.14) for the repair work on the pool APR unit and Munters unit. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately due to the fact <br />that the work has been completed; and further provided it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />
