<br />t ~- <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2009 - 45 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER <br />INTO A RENEWED ONE-YEAR CONTRACT WITH LK <br />HEATING & COOLING INC., WITH A CITY OPTION FOR <br />AN ADDITIONAL ONE YEAR TERM, TO PERFORM <br />MAINTENANCE SERVICES UPON THE HEATING AND <br />COOLING EQUIPMENT AT VARIOUS CITY BUILDINGS, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Director of Public Service has recommended that the City renew <br />its maintenance contract with LK Heating & Cooling for the purpose of providing <br />maintenance services to the heating and cooling equipment at various City buildings, <br />because the service has been good and the prices have remained the same; and <br />WHEREAS, it is the desire of this Council, acting upon the said <br />recommendation, to authorize the Mayor to enter into a renewed one-year contract with <br />LK Heating & Cooling Inc., with a City option for an additional one-year term, to provide <br />said services; <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized enter into a <br />renewed one-year agreement with LK Heating & Cooling Inc., with a City option for a <br />second one-year term at the same prices and upon the same terms and conditions, to <br />provide maintenance upon the heating and cooling equipment in various City facilities, as <br />set forth in the attached nine contracts (marked Exhibits A through I), with only sucl_ <br />changes to said contracts to be hereinafter made as are not substantially adverse to the <br />City and which are approved by the Director of Law. The character of any such changes <br />as not being substantially adverse to the City shall be evidenced conclusively by the <br />execution of the agreements by the Mayor and the approval of the agreements by the <br />Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for further the reason that it is necessary that this Resolution go into effect <br />immediately because the current maintenance contracts expire May 17, 2009 and the <br />services are vital to maintaining the City's public buildings, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />
