CONTRACT UNIVERSITY FlOSPITAL,S OF CLEVELAND SERVICES AGREEMENT THIS AGREEMENT, entered into as of this 15' Day of February ?009, by and between: UNIVERSITY HOSPITALS OF CLEVELAND, Cleveland, Ohio (hereinafter referred to as the "UHC") and the city of North Olmsted and its Police Department (hereinafter refen•ed to as the "subgrantee"), WITNESSETH: WHEREAS, the UHC has received a Project Designed to Increase Safety Belt Use grant (GG-2009-18-00- 00-00622-00) from the Ohio Department of Public Safety (OOPS) and is desirous of engaging the contract agency to provide targeted enforcement activity in completion of the aforementioned grant. NOW, THERFORE, the parties hereto do mutually agree as follows: SERVICE RENDERED BY SUBGRANTEE Targeted enforcement by sworn law enforcement officers done at approved time periods and problem sites in accordance with all applicable laws and grant terms. Targeted enforcement will be conducted in support of the Safety Belt Project goals, which are to increase seat belt use in Cuyahoga County and increase awareness of seat belt use. In addition: a~ Law Enfor•cetnent Reports: Whether or not the subgrantee conducts agrant-related activity, the subgrantee will report enforcement activity on the Agency Traffic Total Form on a monthly basis. Monthly activity reports shall be submitted to the UHC by the 14`h day of the following month. Reports must be submitted electronically (no paper forms) either via e-mail or on disk. Reporting must be submitted using the forms provided by the UHC on a compact disc accompanying this contract. Justification for• time periods and problem sites selected for enforcement activity should be documented and maintained as a part of the subgrantee's file for this Agreement. b.~ Trauiing Certification: The subgrantee will assure that all enforcement personnel to be involved in approved enforcementa•elated activit)+ will be certified in the following types(s) of ri•aining, as appropriate: • Speed-related Traffic Enforcement -- Proper Use of Speed Detection Equipment Training • DUI Checkpoints/Alcohol-related Traffic Enforcement - ADAP/SFST Training and Sobriety Checkpoint Training: training in standard procedures and operations associated with staffing and staging DUI checkpoints and saturation patrols. c.) Enforcement Hours Eligibility: Direct labor how•s expended in traffic safety enforcement programs must be over and above the normal active pay status workweek as defined in the subgrantee's work rules or contracts. Part-time permanent staff is eligible for funding. Only one officer per patrol car will be fwided as part of traffic enforcement grants. d~ Safety Belt Policv: Sub~r•antee must have a policy statement requiring employees to wear safety belts. All personnel working under this contract must wear safety belts Enforcing Safeh+ Belt Lav+s: subgrantee will enforce all safety belt and child passenger safety (CPS) laws on all traffic stops made under this grant. subgrantee must agree to conduct zero- tolerance enforcement of Ohio's occupant restraint laws. Pursuit Policv: subgrantee must have a policy statement regarding the guidelines for malting decisions with regard to vehicular pursuit in accordance with NHTSA and IACP recommendations. Fatal Crash Data Review Committee: subgrantee must provide crash reports in which there was a fatality to the UHC within 30 days of a fatal crash. subgrantee must agree to partici ~ EXHIBIT i v 'r
