<br /> <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 23 <br />By: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO AONE- <br />YEAR RENEWAL OF THE EQUITABLE SHARING AGREEMENT WITH <br />THE UNITED STATES DEPARTMENTS OF JUSTICE AND TREASURY <br />TO PROVIDE FOR TRANSFER OF CASH OR PROPERTY SEIZED AND <br />FORFEITED IN CONNECTION WITH CRIMINAL PROSECUTION AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the United States Departments of Justice and Treasury operate and offer the <br />City the opportunity to continue participation in the Federal Equitable Sharing program, which <br />provides and allows for the transfer and release of assets to the City of North Olmsted, including <br />cash, that may be seized and forfeited upon successful law enforcement efforts by the North <br />Olmsted Police Department and based upon criminal prosecution thereof; and <br />WHEREAS, the Federal Equitable Sharing Agreement, Annual Certification Report and <br />Affidavit forms, attached as Exhibit A, are required by the United States Departments Justice and <br />Treasury so that the City and NOPD can maintain participation for 2009; and <br />WHEREAS, it is the recommendation of the Chief of Police and Director of Public <br />Safety that said Agreement and other forms be approved and renewed for the year 2009: in <br />anticipation of successful seizure and forfeiture of assets procured through criminal conduct; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br />into a one year renewal of the Equitable Sharing Agreement with the federal government and to <br />support the law enforcement efforts of the North Olmsted Police Department; and <br />NOW, THEREFORE, BE IT RESOLVED B Y THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into one-year <br />renewal of the Equitable Sharing Agreement with the United States Departments of Justice and <br />Treasury, for the period January 1, 2009 through December 31, 2009, in order to provide for <br />participation in the seizure and forfeiture of criminal assets, as described and regulated therein, <br />together with additional Annual Certification Report and Affidavit associated therewith. The <br />renewal Agreements shall be in form and substance of the attached two Flat Rate Service <br />Agreements, having a total of five (5) pages, marked as Exhibit A and attached hereto, with only <br />such changes to be hereinafter made in said contracts as are not substantially adverse to the City <br />
