' ,, `* <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2009 -10 <br />BY: Mayor O'Grady <br />AN ORDINANCE AMENDING THE TRAFFIC CONTROL <br />FILE OF THE CITY OF NORTH OLMSTED TO PROVIDE <br />FOR THE REMOVAL OF ALL SIGNS PROHIBITING <br />TRUCK TRAFFIC AND OTHER CLASSES OF VEHICLE <br />AND VEHICLE LOAD ON STEARNS ROAD, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, as a condition to the City receiving funding for the proposed widening and <br />extension of Stearns Road in North Olmsted, this Council, on December 21, 2004, adopted <br />Ordinance 2004-183, which authorized the Mayor to enter into an agreement with the Ohio <br />Department of Transportation ("ODOT") and Cuyahoga County in which the City, among other <br />things, agreed not to locally prohibit any class of vehicle or vehicle load permitted by the Ohio <br />Revised Code from using the new and newly reconstructed sections of the road; and <br />WHEREAS, this Council, based upon the foregoing, and now that the widening and <br />extension of Stearns Road has been completed, has determined that it is in the best interest of the <br />safety, health and welfare of the citizens of the City of North Olmsted to remove all signs on <br />Stearns Road that purport to prohibit truck traffic on that Road, and accordingly, by this adoption <br />of this ordinance, will authorize the City Administration to do so; and <br />WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of the Traffic <br />Control File, which file can be amended only by ordinance duly adopted by this Council; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND THE STATE OF OHIO: <br />SECTION 1: That the Police Department be and the same is hereby authorized and <br />directed to amend the Traffic Control File of the City of North Olmsted to indicate thereon the <br />removal of all signs prohibiting any class of vehicle or vehicle load permitted by the Ohio <br />Revised Code, including trucks, to use Stearns Road. <br />SECTION 2: That the Director of Public Safety be and is hereby authorized to cause the <br />removal of any such signs on Stearns Road that purport to prohibit any class of vehicle or vehicle <br />load permitted by the Ohio Revised Code, including trucks. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to remove traffic control signs that are no longer <br />legally permitted on Stearns Road, and further provided that it receive the affirmative vote of <br />two-thirds of the members of this Council, it shall take effect and be in force immediately c ron <br />its passage and approval by the Mayor. <br />
