A. . _. <br />:,?.. .?..?..,..,.. , <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-158 <br />BY: COUNCIL MEMBERS LIlVIPERT AND MII.LER. <br /> <br />AN ORDINANCE CREATING NEW SECTION 739.05 OF THE BUSINESS <br />REGULATION CODE, ENTITLED "RETAIL GAS PRICE REGULATIONS," FOR <br />THE PURPOSE OF PROHIBITING SiIPPLIERS OF GASOLINE TO THE PUBLIC <br />FROM CHARGING A RETAIL PRICE WHICH IS MORE THAN FIFTY PERCENT <br />(SO%) HIGHER THAN THE AVERAGE RETAIL PRICE PER GALLON IN <br />CUYAHOGA COUNTY, AS DETERMINED BY THE COUNTY AIIDITOR, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, due to the continuing national emergency brought on by the tenorist acts of <br />September 11, there exists a need to regulate gasoline prices in the community to prevent <br />unscrupulous merchants from gouging the motoring public; and <br />WHEREAS, this Council believes that this community need can be addressed by a minimal <br />regulation which affects only those merchants who attempt to charge a retail price for gasoline which <br />exceeds by fifty-percent (50%) the average retail price for gasoline in the County, as determined by <br />the County Auditor; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there is hereby created new Section 739.05 of the Business Regulation <br />Code, entitled "Retail Gas Price Regulations" which, as created, sha11 read in its entirety as <br />follows: <br />SECTION 739.05 RETAIL GAS PRICE REGULATIONS. <br />(a) No person, company or other entity shall in the City of North Olmsted charge any <br />person, company or other entity a retail price for gasoline which is more than fifty-percent (50%) <br />higher per gallon than the average retail price per gatlon for gasoline in Cuyahoga County, Ohio, <br />as determined by the County Auditor. <br />(b) A violation of paragraph (a) of this Section sha11 be deemed to be a first degree <br />misdemeanor and punished accordingly. <br />(c) This Section sha11 remain in force and effect only for so long as the current national <br />emergency continues, which, for purposes of this section, shall be deemed to have ended on the <br />second anniversary of the effective date of the Ordinance adopting this Section.
