,?..... ...? . .,,... _ _ , L • . .... ; .,.:.wy I CITY OF NORTH OLMSTED ORDINANCE NO. 2001-155 BY: MAYOR MUSIAL AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE PURCHASE OF A PORTION OF THE PROPERTY LOCATED AT THE VACANT LOT ON CLAGUE ROAD IMNIEDIATELY TO THE SOUTH OF THE CVS STORE AT 23345 LORAIN ROAD, NORTH OLMSTED, OHIO (PERMANENT PARCEL NO. 237-9-5) FOR THE PURPOSE OF WIDENING CLAGUE ROAD, AND DECLARING AN EMERGENCY. WHEREAS, this Council has reviewed plans and approved financing for the proposed widening of Clague Road at and near its intersection with Lorain Road; and WHEREAS, this Council heretofore authorized and directed the Director of Law of the City of North Olmsted, to negotiate for the acquisition of all property necessary for the said road widening project; and WHEREAS, it is necessary, for the road widening project, to acquire a portion of the real property located at the vacant lot on Clague Road immediately to the south of the CVS store at 23345 Lorain Road and identified as Permanent Parcel Number 237-9-5; and WHEREAS, the Director of Law has consistent with the order of Council to do the same, successfully negotiated a contract with Retail Today Limited, the owner of said property located at the vacant lot on Clague Road immediately to the south of the CVS store at 23345 Lorain Road, a copy of which is attached hereto and marked Exhibit "A". NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an Agreement in the substantial form as that which is attached hereto and made a part hereof and marked Exhibit "A" with Retail Today Limited for the acquisition of a portion of its property located at the vacant lot on Clague Road immediately to the south of the CVS store at 23345 Lorain Road, North Olmsted, Ohio.
