,?.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-154 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />FOR THE PURCHASE OF A PORTION OF THE PROPERTY LOCATED AT 3839 <br />CLAGUE ROAD, NORTH OLMSTED, OHIO (PERMANENT PARCEL NOS 237-I1-25 <br />AND 237-11-60) FOR THE PURPOSE OF WIDENING CLAGUE ROAD, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council has reviewed plans and approved financing for the proposed <br />widening of Clague Road at and near its intersection with Lorain Road; and <br />WHEREAS, this Council heretofore authorized and directed the Director of Law of the City <br />of North Olmsted, to negotiate for the acquisition of all property necessary for the said road widening <br />project; and <br />WHEREAS, it is necessary, for the road widening project, to acquire a portion of the real <br />property located at 3839 Clague Road and identified as Permanent Parcel Numbers 237-11-25 and <br />237-11-60; and <br />WHEREAS, the Director of Law has consistent with the order of Council to do the same, <br />successfully negotiated a comract with Phyllis Sturgeon, the owner of said property located at 3839 <br />Clague Road, a copy of which is attached hereto and marked Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />Agreement in the substarrtial form as that which is attached hereto and made a part hereof and marked <br />Exhibit "A" with Phyllis Sturgeon for the acquisition of a portion of her property located at 3839 <br />Clague Road, North Olmsted, Ohio. <br />SECTION 2: This Ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare within the City, <br />and for the further reason that it is necessary to immediately acquire the property needed for the road <br />widening project so that State grant monies are not lost, and further provided it receives the <br />affirrnative vote of two-thirds of all the members of Council, this Ordinance shall take effect and be <br />in force immediately upon its passage by the Council and approval by the Mayor; otherwise it shall <br />take effect and be in force after the earliest period allowed by law.
