This Agreement, entered into at North Olmsted, Ohio this ?J day of e?2C 1c)IIj,<?`2001 by and between the City of North Olmsted, 5200 Dover Center Road, North Olmsted, Ohio 44070 (hereinafter, the "Purchaser"), and Phyllis I. Sturgeon, 3839 Clague Road, North Olmsted, Ohio 44070 (hereinafter the "Seller"). WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain portion of the real property located at 3839 Clague Road, North Olmsted, Ohio, Permanent Parcel #237-11-25 and 237-11-60, which shall become part of the right-of-way in connection with the proposed widening of Clague Road; and WHEREAS, the purchase of this property has been authorized by North Olmsted Ordinance Number 2001- NOW THEREFORE, on the basis of the foregoing premise, for the consideration hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: ITEM ONE: Purchase and Sale of Real Prouertv Subject to the terms and conditions of this Agreement, the Seller agrees to sell and the Purchaser agrees to purchase all of the Seller's right, title and interest in the above-mentioned part of the real property, which is located at 3839 Clague Road, North Olmsted, Ohio. The real property being sold is a somewhat triangular piece of land along Clague Road, consisting of 189.878 square feet, and legally described in atta.ched Exhibit "A," and depicted on the plat marked as Exhibit "B." In addition, Seller agrees that it shall fully cooperate with the City and do all acts necessary in the splitting offof said piece ofland from its property at 3839 Clague Road,
