c CITY OF NORTH OLMSTED ORDINANCE NO. 2001-153 BY: MAYOR MUSIAL AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE PURCHASE OF A PORTION OF THE PROPERTY LOCATED AT 23345 LORAIN ROAD, NORTH OLMSTED, OHIO (PERMANENT PARCEL NO. 237-9-1) FOR THE PURPOSE OF WIDENING CLAGUE ROAD, AND DECLARING AN EMERGENCY. WHEREAS, this Council has reviewed plans and approved financing for the proposed widening of Clague Road at and near its intersection with Lorain Road; and WHEREAS, this Council heretofore authorized and directed the Director of Law of the City of North Olmsted, to negotiate for the acquisition of all property necessary for the said road widening proj ect; and WHEREAS, it is necessary, for the road widening project, to acquire a portion of the real property located at 23345 Lorain Road and identified as Permanent Parcel Number 237-9-1; and WHEREAS, the Director of Law has consistent with the order of Council to do the same, successfully negotiated a cornract with North Olmsted-Gettysburg, the owner of sa.id property located at 23345 Lorain Road, a copy of which is attached hereto and marked Exhibit "A". NOW, THEREFORE, BE IT ORDAINED BY THE COUIVCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an Ageement in the substamial form as that which is attached hereto and made a part hereof and mazked Exhibit "A" with North Olmsted-Gettysburg for the acquisition of a portion of its property located at 23345 Lorain Road, North Olmsted, Ohio. SECTION 2: This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare within the City, and for the further reason tha.t it is necessary to immediately acquire the property needed for the road widening project so that State grant monies are not lost, and further provided it receives the affirmative vote of two-thirds of all the members of Council, this Ordinance sha11 take effect and be in force immediately upon its passage by the Council and approval by the Mayor; otherwise it shall take effect and be in force after the earliest period allowed by law.
