<br />and authorizes the appropriation of, for the purpose of widening Clague Road, the fee simple title <br />interest in and to portions of the following parcels of real property located in the City of North <br />Olmsted: Permanent Parcel Nos. 231-12-12, 231-12-317 thru 231-12-395, 231-12-17, 231-12- <br />35, 237-9-4, and 237-8-1. The legal descriptions and maps of said portions of the parcels of real <br />property which are to be appropriated are attached to this Ordinance as Exhibits lA-B through <br />6A-B inclusive, and are expressly incorporated herein by reference as if fully stated herein. <br />SECTION 2: That the Mayor of the City of North Olmsted is authorized and directed to <br />cause written notice of adoption of this Ordinance to be given to each owner of the parcels of real <br />property described in Section 1 of this Ordinance, to each person in possession of any of the said <br />parcels of real property, and to each person having an interest of record in any of the said parcels <br />of real property, or to the authorized agents of those persons. Notice shall be served by a person <br />designated by the Mayor for that purpose, and such notice shall be served and return made in the <br />manner provided for in the service and return of summons in civil actions. If any such owner, <br />person or agent cannot be found, notice shall be given by publication once a week for three <br />consecutive weeks in a newspaper of general circulation in the City. <br />SECTION 3: That it is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Ordinance were taken at meetings of this Council <br />and of its committees, if any, which were open to the public in compliance with law. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />additional reason that this ordinance must go into effect immediately so that the appropriation <br />proceedings may be commenced in a manner and upon a time schedule which will not interfere <br />with or delay the scheduled construction of the widening of Clague Road, and further provided it <br />receives the affirmative vote of two-thirds of a11 members of Council, it sha11 take effect and be in <br />force inT?diately upon its passage and approval by the Mayor. <br />.. <br />PASSED: 4,?,?x-? z.. ??,.. c? ?.?L .? ,, a ot, i <br />A/?ST?a..?. -z,- <br />t? <br />L SEMAN <br />Clerk of Council <br />11 <br />VED: r ?Z`101 <br />7 .? &1.,?.???/ <br />MAYOR NORMAN T.IVIUSIAL <br />Approved as to Lega1 Form: <br />.. <br />a' <br />J T A.
