<br />laboratory analysis of a composite sample prepared from
<br />discrete samples of the biosolids in each container
<br />transported to the City of North Royalton, Ohio
<br />Composting Facility for percent total solids, percent
<br />volatile solids, total phosphorus, total nitrate+nitrite
<br />nitrogen, total kjeldhal nitrogen, total ammonia, fecal
<br />coli, pH, total recoverable aluminum, total recoverable
<br />arsenic, total recoverable bis(2-ethylexyl) phthalate,
<br />total recoverable cadmium, total recoverable chromium,
<br />total recoverable copper, total recoverable cyanide,
<br />total recoverable iron, total recoverable lead, total
<br />recoverable mercury, total molybdenum, total recoverable
<br />nickel, total recoverable potassium, total recoverable
<br />selenium, and total recoverable zinc.
<br />C. The City of North Olmsted agrees to complete a quarterly
<br />laboratory analysis of a composite sample prepared from
<br />discrete samples of the biosolids in each container
<br />transported to the City of North Royalton, Ohio
<br />Composting Facility for total recoverable dioxin scan
<br />and total recoverable polyvinyl chloride (PCB).
<br />D. The City of North Royalton, Ohio agrees to accept at
<br />least one 23 cubic yard container of North Olmsted
<br />Wastewater Treatment Plant biosolids at the City of
<br />North Royalton, Ohio Composting Facility each day Monday
<br />through Friday over the duration of this agreement
<br />except for holidays recognized by both the City of North
<br />Olmsted, Ohio and the City of North Royalton, Ohio.
<br />E. The City of North Royalton, Ohio agrees to stabilize and
<br />then dispose of all North Olmsted Wastewater Treatment
<br />Plant biosolids accepted by the City of North Royalton,
<br />Ohio at the City of North Royalton, Ohio Composting
<br />Facility in accordance with the biosolids stabilization
<br />and disposal requirements placed on the City of North
<br />Royalton, Ohio by the Ohio Environmental Protection
<br />Agency in effect for the duration of this agreement.
<br />SECTION IV - FORCE MAJEURE AND DISPUTES (this needs to be
<br />negotiated between the directors of law for each city!!!)
<br />A. Neither the City of North Olmsted, Ohio nor the City of
<br />North Royalton, Ohio shall not be held responsible for
<br />failure to perform, due to events beyond the control of
<br />either city. Such events may include Acts of God, fire,
<br />epidemics, earthquakes, flood or other natural
<br />disasters, acts of the government, riots, strikes, war
<br />or civil disorders.
<br />B. Any controversy or claim arising out of or relating to
<br />the provision of this Contract Agreement, or the breach
