<br />??.... <br />10owk <br />5.01 Seller acknowledges and agrees that it shall have no salvage rights to any of the <br />building or fixtures on the Property, or to any tangible personal property which may be located <br />within any of the said buildings, or which is otherwise located upon or attached to the Property. <br />Buver to Purchase Propertv "As Is" <br />5.02 Except as otherwise specified herein, Buyer acknowledges that the Property is being <br />purchased for purposes of the construction of a new library building. All structures will be <br />removed from the Property. Consequently, the City waives any disclosure requirements relating <br />to the condition of the buildings upon the Property and agrees to take the Property in an "as is" <br />condition. <br />Assignment of Agreement <br />5.03 This Agreement sha11 be binding upon the respective heirs, executors, <br />administrators, successors, and to the extent assignable, on the assigns or nominees of the parties <br />hereto. <br />Environmental Assessment <br />5.04 This Agreement is contingent upon an environmentai assessment to be conducted at <br />Buyer's expense, prior to Closing, disclosing no violations of any state or federal environmental <br />law or regulations; Seller shall provide to Buyer any and all prior environmental reports in Seller's <br />possession. Buyer shall be responsible for all costs of obtaining governmental approvals. From <br />and after execution of this Agreement and until Closing, Buyer and Buyer's agents sha11 have full <br />right of ingress and egress over and through the Property for the purposes of (a) inspection, <br />performing enviranmentat tests, engineering andlor architectural drawings, and other such <br />observations and tests as Buyer may desire, all of which, except as otherwise set forth in this <br />Agreement, shall be at Buyer's expense. <br />Real Estate Broker/Agent <br />5
