PRELIMINARY LEGISLATION ? <br />aev. wz6(oo <br />Ordinance No. 2001-137 <br />PID No. 21512 <br />Cty-Rte-Sec CUY-252-05.50 <br />BY: MAYOR MCTSIAL <br />An emergency ordinance enacted by the City of North Olmsted, County of Cuyahoga, Ohio, in the <br />matter of the hereinafter described improvement. <br />SECTION I (Project DescripNon) <br />WHEREAS, the City/State has identified the need for and proposes the improvement of the public <br />highway which is described as follows: <br />Apply an edge-to-edge of pavement surface treatment to Columbia Road (SR-252) <br />from Lorain Road (SR-10) to the North Corporation Line in the City of North <br />Olmsted, a distance of 1.02 miles more or less. This work is part of a larger project <br />involving the City of Westlake. <br />WHEREAS, said portion of highway is within the municipal corporation limits. <br />NOW THEREFORE, be it ordained by the Council of the City of North Olmsted, Ohio: <br />SECTION II (Consent) <br />That it is declared to be in the public interest that the consent of said City be and such consent is hereby <br />given to the Director of Transportation to construct the above described improvement, in accordance with <br />plans, specifications and estimates as approved by the Director. <br />SECTION III (Cooperation) <br />That the City hereby requests the cooperation of the Director of Transportation in the cost of the above <br />described improvement as follows: <br />The City agrees to assume and contribute twenty percent (20%) of the cost and <br />expense of the construction phase of this improvement determined to be eligible for <br />State Highway Funds. In addiNon, the City shall install andlor repair all curb ramps <br />which are necessary to ensure compliance with the Americans with Disabilities Act and <br />the City agrees to assume and bear one hundred percent (100%) of the cost of such <br />installation and/or repair of curb ramps. <br />And further, the City agrees to assume and contribute one hundred percent (100%) <br />of the cost of any work included in the construction contract, at the request of the City, <br />which is determined by the Director not to be part of or made necessary by the <br />improvement. <br />Page 1 of 3
