<br />?,. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-123 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLM5TED TO ENTER INTO AN AGREEMENT, MODIFYING THE PRESENT <br />CONTRACT BETWEEN THE CITY AND CARRIE SKA.LL TIPTON, RELATING <br />TO THE SERVICES SHE RENDERS TO THE CITY AS A GYMNASTICS AND <br />EXERCISE INSTRUCTOR AT THE NORTH OLMSTED RECREATION <br />CENTER, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City and Carrie Skall Tipton are parties to a contract, wherein Tipton <br />provides gymnastics and exercise program services at the City's Recreation Center; and <br />N'HEREAS, Tipton no longer desires to provide exercise program services at the <br />Recrea.tion Center; and <br />WHEREAS, it is the recommendation of the Recreation Commissioner, with the support <br />of the Director of Public Safety, that the contract between the City and Tipton be modified to, <br />first, terminate her duties and responsibilities as an exercise program instructor, and, secondly, <br />address differently the obligations of the parties regarding the purchase of gymnastics <br />equipmem; and <br />WHEREAS, it is the desire of this Council, first, to ratify the original contract between <br />the City and Tipton; and <br />WHEREAS, it is fixrther the desire of this Council to authorize the Mayor to enter into <br />the modified agreement with Tipton, eliminating her duties to provide the City with adult <br />exercise class instructions; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into an Agreement <br />with Carrie Ska11 Tipton modifying the provisions of the originai contract between the City and <br />Tipton, in substantially the form and substance as evidenced in the Modified Contract for <br />Services, attached to this Ordinance as `Exhibit A." Said modified contract shall be effective <br />retroactively to September 4, 2001.
