<br />MODIFIED CONTRACT FOR SERVICES
<br />THIS AGREEMENT is made [dateJ, at the City of North Olmsted, County of
<br />Cuyahoga, State of Ohio, between the City of North Olmsted, a municipal corporation ("the City"),
<br />and Karrie Skall Tipton, 24213 Maria Lane, North Olmsted, Ohio, ("Instructor").
<br />WHEREAS, the Instructor has provided both gymnastics and adult exercise instruction for
<br />the City at the North Olmsted Recreation Complex pursuant to contract since September 1, 1999;
<br />and
<br />WHEREAS, the parties desire to modify the cantract so that, effective 5eptember 4, 2001,
<br />the only services which the Instructor will render ta the City until the end of the term of the contract,
<br />to-wit: August 31, 2001, will be gymnastic instructions;
<br />NOW, THEREFORE, the parties have agreed to the following modified terms, covenants,
<br />and conditions set forth below, acknowledging that sufficient consideration exists for said
<br />modifications:
<br />Section I
<br />Nature of and Place of Services
<br />Instructor shall administer a progam of gymnastics instruction for the City, and shall
<br />perform such other duties as are customarily perfornled by one holding such position in other
<br />similar businesses or enterprises as that engaged in by the City, and shall also additionally render
<br />such other and unrelated services and duties as may be assigned to Instructor from time to time by
<br />the City. Effective September 4, 2001, Instructor shall have no further obligations under the
<br />Contract to provide adult exercises instructions and the City will have no obligation to provide
<br />compensation to Instructor for adult exercise instruction. Instructor shall, for the balance of the term
<br />of the original Contract, provide only gymnastics instructions and shall be compensated only for
<br />such gymnastic services provided.
<br />Section II
<br />Manner of Performance of Services
<br />Instructor agrees to perform, at all times faithfully, industriously, and to the best of her
<br />ability, experience, and talent, all of the duties that may be required of and from her pursuant to the
<br />express and implicit terms of this modified agreement, to the reasonable satisfaction of the City.
<br />Such duties shall be rendered at North Olmsted Recreation Complex, and at such other place or
<br />places as the City shall in good faith require or as the interests, needs, business, and opportunities of
<br />the City shall require or make advisable.
