(u) "Person" shall be mean any individual, corporation, business trust, estate, trust, partnership, <br />limited liability company, or other association. <br />(v) "Erect" shall mean to build, construct, alter, relocate, modify, attach, hang, place, suspend, or <br />affix, and shall also include the painting of signs." <br />SECTION 2: That Section 1163.10 of the Zoning Code, entitled "Nonconfornung Signs," <br />which presently read as follows <br />"1163.10 NONCONFORMING SIGNS. <br />Nonconforming signs may be maintained, except: <br />(a) No nonconforming sign or part thereof shall be altered, modified, relocated, or changed in any <br />manner whatsoever in any process of reconstruction, repair, maintenance, or restoration, when the <br />cost of said reconstruction, repair, maintenance, or restoration exceeds fifty percent (50%) of the <br />sign's replacement cost, unless the entire sign shall be brought into compliance with all of the <br />provisions of this Chapter, and all other applicable City laws and ordinances. <br />(b) Any nonconfornung sign the use of which is discontinued for a period of thirty (30) days or <br />more shall either be removed or brought into compliance with a11 of the provisions of this Chapter <br />and all other applicable City laws and ordinances. <br />(c) Any nonconforming sign for a property or premises that undergoes a change of use <br />(permitted), as that term is defined in this Zoning Code, shall be brought into compliance with a11 <br />of the provisions of this Chapter and all other applicable City laws and ordinances." <br />be amended, and, as amended, shall read in its entirety as follows: <br />"1163.10 NONCONFORMING SIGNS. <br />Nonconforming signs may be maintained, except: <br />(a) No nonconforming sign or part thereof shall be altered, modified, relocated, or changed in any <br />manner whatsoever in any process of reconstruction, repair, maintenance, or restoration, when the <br />cost of said reconstruction, repair, maintenance, or restoration exceeds fifty percent (50%) of the <br />sign's replacement cost, unless the entire sign shall be brought into compliance with all of the <br />provisions of this Chapter, and all other applicable City laws and ordinances. <br />(b) Any nonconfornung sign the use of which is voluntarily discontinued for a period of at least <br />six (6) manths shall either be removed or brought into compliance with a11 af the pravisions of this <br />Chapter and all other appliaable City laws and ordinances. <br />(c) Any nonconforming sign for a property or premises that undergoes a change of use <br />(permitted), as that term is defined in this Zoning Code, shall be brought into compliance with all <br />of the provisions of this Chapter and all other applicable City laws and ordinances." <br />SECTION 3: That Section 1163.15 of the Zoning Code, entitled "Abandoned Signs <br />Prohibited," which presently read as follows: <br />1163.15 ABANDONED SIGNS PROHIBITED. <br />Signs which are abandoned, or which are accessory to an abandoned use of property, are <br />prohibited and shall be removed. A use shall be determined abandoned if it has ceased its <br />operations for a least ninety consecutive days, unless the use is typically seasonal.
