CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001- 77 <br />BY.• MAYOR MUSIAL <br />AN ORDINANCE CREATING NEW SECTION 915.20 OF <br />THE STREETS, UTILITIES AND PUBLIC SERVICES CODE, <br />IN ORDER TO PROVIDE AUTHORIZED PAYMENT <br />METHODS REGARDING THE COLLECTION OF <br />NONBILLED SEWER USER CHARGES, AND DECLARING <br />AN EMERGENCY AS AMENDED. <br />WHEREAS, on September 21, 1999, this Council adopted Ordinance No. 99-66 which <br />created new Section 915.19 of the City Streets, Utilities and Public Services Code providing a <br />method of collecting delinquent unbilled sanitary sewer charges; and <br />WHEREAS, this Council desires now to create new legislation in order implement <br />Section 915.19 by establishing payment methods for previously unbilled users who owe <br />delinquent charges, and to further provide relief for residents with serious economic hardships; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Section 915.20 of the Streets, <br />Utilities and Public Services Code, which, as created, shall read in its entirety as follows: <br />"915.20 PAYMENT REGULATIONS; HARDSHIP CONSIDERATION. <br />(a) The following payment regulations shall apply for unbilled sanitary sewer charges <br />owed by users pursuant to Section 915.19 of this Chapter as follows: <br />(1) For amounts due less than or equal to $300.00, users shall be required to <br />make a single payment to the Director of Finance in the full amount due; <br />(2) For amounts due in excess of $300.00, installment payments may be <br />authorized by the Director of Finance, provided that the first installment payment made by a user <br />must be at least in the amount of $300.00, and the total amount due by the user must be paid to <br />the City within 12 months from the date of first billing. <br />(b) Where economic hardship is claimed by a residential user who owes the City an <br />amount determined pursuant to Section 915.19, the Director of Public Service, the Director of <br />Finance and the Human Resources Director shall jointly review the claim, and, upon finding that <br />a serious economic hardship exists for the user, are authorized, based upon the majority vote, to <br />reduce minimum initial payments due, extend the time period during which payment must be in <br />full to the City, and/or reduce the total amount which is due to the City."
