leave days earned may be carried over, if not taken within one (1) year of date of day <br />earned, to the failowing year, with a maximum of five (5) days. <br />ARTICLE 21: <br />OTHERLEAVES OFABSENCE <br />SECTION 1: A regular full-time empfayee who has completed his probationary period <br />and who has exhausted his paid sick leave shall be granted a leave of absence without <br />pay for a period of up to 120 calendar days for a continuing disability which is <br />substantiated by credible medical evidence. If the illness or disability continues beyond <br />120 calendar days, additional sick leave may be granted by the City upon request, up to <br />an additional 75 days. The employee shall be required to submit proof acceptable to the <br />City of his ability to perform the work of his job upon the termination of the sick leave. If <br />the Employer believes that the employee failed to submit satisfactory proof of illness or <br />injury upon request, or in the event that upon receipt of a physicians statement or an <br />affidavit for doctor/hospital record form and the City believes there is not evidence of <br />illness or injury sufficient to justify the empfoyee's absence, the employer shall have the <br />right to have the employee examined by a doctor of its choice within seven days. The <br />charges for the second physician shall be borne by the City. If disagreement thereafter <br />exists, a third physician shall be mutuaily selected by the Union and the City to <br />determine the issue. The cost of such examination shall be shared equally by the <br />employer and the Union. If it is determined that there is not evidence of illness or injury <br />to justify the employee's absence; sick leave may be considered an unauthorized leave, <br />and may be the cause for discipfinary action. <br />SECTION 2: Afl unpaid leaves of absences (and extensions thereof) must be applied <br />for and granted or rejected within three (3) working days, in writing, on forms to be <br />provided by the Employer and with approval of the Chief of Police and the Safety <br />Director. <br />SECTION 3: An employee may return to work prior to the expiration of any leave of <br />absence. Providing said employee gives the Employer a minimum of five days notice. <br />SECTION 4: Employees who leave the service of the City to enter the United States <br />Armed Forces, or the service of the Maritime Commission, and who return within ninety <br />(90) days from release from the service, shall be granted seniority rights upon their <br />return as if continuously employed by the City during such service. - <br />SECTION 5: PART A: <br />All employees of the bargaining unit who are members of the Ohio <br />National Guard, the Ohio Defense Corps, or members of other reserve components of <br />the Armed Forces of the United States, are entitled to leaves of absence for such <br />mifitary service for field training, active duty or emergency call-out for a period not to <br />19
