., , <br />ARTICLE 34 <br />MATRON DUTIES <br />SECTION 1: Every effort wiil be made to ensure that Emergency Central Dispatchers <br />are used as a last resort for matron duties. On duty female police officers, on duty <br />secretaries, and on duty female auxifiary officers, employed by the City, shall be <br />contacted prior to an Emergency Central Dispatcher being required/ordered to search <br />female prisoners. The City further agrees that the members of the bargaining unit will <br />not be requested/ordered to search prisoners for other area police departments. <br />ARTICLE 35 <br />WAIVER IN CASE OF EMERGENCY <br />SECTION 1: In case of emergency declared by the President of the United States, the <br />Governor of the State of Ohio, the Mayor of the City of North Olmsted, the Federal or <br />State Legislature, such as acts of God and civil disorder, the following conditions of this <br />Agreement shal( automatically be suspended: <br />a) time limits for Management or the Union's repfies on grievances <br />b) all work rules and/or provisions of agreements or practices directly relating to the <br />assignment of all employees. <br />SECTION 2: Upon the termination of the emergency, should valid grievances exist, <br />they shall be processed in accordance with the provisions outlined in the Grievance <br />Procedure of this Agreement and shall proceed from the point in the grievance <br />procedure to which they (the grievance(s)) had properly progressed. <br />ARTICLE 36 <br />SEVERABILITY <br />SECTION 1: If during the life of this Agreement, any of the provisions contained herein <br />are held to be invalid by operations of law or by any tribunal of competent jurisdiction, <br />the remainder of the Agreement shall not be affected thereby. In the event any <br />provision herein is so rendered invalid, upon written request by either party hereto, the <br />Employer and the Union will meet promptly for the purpose of discussing a mutualiy <br />satisfactory replacement for such provisions. <br />29
