CITY OF NORTH OLMSTED ORDINANCE NO. 2001 - 60 BY: MAYOR NORMAN MUSIAL AN ORDINANCE DECLARING THE NECESSITY AND INTENTION OF THE CITY OF NORTH OLMSTED, OHIO, TO APPROPRIATE CERTAIN PARCELS OF REAL PROPERTY IN THE CITY FOR THE PURPOSE OF BUILDING A NEW PUBLIC LIBRARY, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted intends to build a new public library within the City to be located, in part, upon certain parcels of real property fronting on or located near Lorain Road, and known as Permanent Parcel Nos. 232-11-021, 232-11-022, 232-11-024, and 232-11-030; and WHEREAS, the City has already acquired title to four other parcels of land which essentially abut the aforementioned parcels to the south and which constitute the remaining portion of the future site of the said proposed new library; and WHEREAS, it is a public necessity to build the aforementioned public library due to the fact that the City's current library facility, which is more than 35 years old, no longer adequately fulfills the library needs of the residents of the City of North Olmsted and does not sufficiently support new technologies available to modern libraries; and WHEREAS, in order to build this library it will be necessary for the City of North Olmsted to acquire fee simple title in the aforementioned remaining four parcels of real property fronting on or located near Lorain Road; and WHEREAS, negotiations between the duly authorized representatives of the City and the owners of the aforementioned four parcels described in this Ordinance have failed to result in any agreement for the purchase of the real estate for reasonable compensation acceptable to the City and those property owners. NOW, THEREFORE, BE IT ORDAINED BY THIS COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. SECTION 1: That this Council deems it necessary, declares its intention to appropriate, and authorizes the appropriation of, for the purpose of building a new public library, the fee simple title interest in and to the following parcels of real property located in the City of North Olmsted: Permanent Parcel Nos. 232-11-021, 232-11-022, 232-11-024, and 232-11-030. The legal descriptions for said four parcels of real property are attached to this Ordinance as Exhibits 1 through 4 inclusive, and are expressly incorporated herein by reference as if fully stated herein.
