Owner: <br />Architect: ? <br />ARTICLE 2 SCOPE OF ARCHtTECT'S BASIC SERVICES <br />2.6 CONSTRUCTION PHASE - ADMINISTRATION OF THE CO(dSTRUCTION <br />CONTRACT <br />2.6.5.1 The Architect shall be compensated for site visits during the Construction <br />Administration phase in excess of five (5) in accordance with subparagraphs 11.3.2 and <br />1133., when these additional site visits are requested by Owner. <br />The Architect's review of Contractor's submittals, as part of Basic Services, shall be <br />limited to an inirial submittal and one resubmittal. Services by the Architect for review <br />of additional resubmittals shall be compensated in accordance with Subparagraphs <br />11.3.2 and 11.33. <br />2.6.19 If the Owner authorizes deviations, recorded or unrecorded, from the documents <br />prepared by the Architect without written agreement of the Architect, the Owner shall <br />indemnify and hold harmless the Architect, Architect's consultants and agents and <br />employees of any of them from and against claims, damages, losses and expenses, <br />including but not limited to attorney's fees, arising out of or resulting in whole or in part <br />from such deviations, regardless of whether or not such claim, damage, loss or expense <br />is caused in part by a party indemnified hereunder. <br />ARTICLE 4 OWNER'S RESPONSIBILITIES <br />ARTICLE 6 USE OF ARCHITECT'S INSTRUMENTS OF SERVICE <br />The Owner shall indemnify and hold hacmless the Architect, the Architect's consultants <br />and agents, and employees of any of them, from and against claims, damages, losses, <br />and expenses, including but not limited to attorneys' fees arising out of unauthorized use <br />of the Instruments of Service. <br />ARTICLE 9 MISCELLANEOUS PROVISIONS <br />Therefore, Owner agrees to hold-harrriless and indemnify the Architect for all claims, <br />lawsuits, expenses or damages, including defense costs, arising from or related to the <br />handling, use, treatment, purchase, sale, storage or disposal of asbestos, asbestos <br />products or any other hazardous materials. <br />B 151 Art12 - Rev. 4/24/99 B 151-1997 - Page - 20 - <br />f:lprojects11520 - springvale country club1b151art12.doc
